| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Section 61.022, Parks and Wildlife Code, is |
|---|
| 15 | 15 | | amended by adding Subsection (b-1) to read as follows: |
|---|
| 16 | 16 | | (b-1) A court shall order a defendant convicted of an |
|---|
| 17 | 17 | | offense under this section to make restitution to the owner of the |
|---|
| 18 | 18 | | land, submerged land, or water. Restitution under this section may |
|---|
| 19 | 19 | | not include a payment for the value of wildlife or wildlife remains. |
|---|
| 20 | 20 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 21 | 21 | | an offense committed on or after the effective date of this Act. An |
|---|
| 22 | 22 | | offense committed before the effective date of this Act is covered |
|---|
| 23 | 23 | | by the law in effect when the offense was committed, and the former |
|---|
| 24 | 24 | | law is continued in effect for that purpose. For purposes of this |
|---|
| 25 | 25 | | section, an offense was committed before the effective date of this |
|---|
| 26 | 26 | | Act if any element of the offense was committed before that date. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2013. |
