99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the payment of restitution for the taking of wildlife
1212 resources without the property owner's consent.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 61.022, Parks and Wildlife Code, is
1515 amended by adding Subsection (b-1) to read as follows:
1616 (b-1) A court shall order a defendant convicted of an
1717 offense under this section to make restitution to the owner of the
1818 land, submerged land, or water. Restitution under this section may
1919 not include a payment for the value of wildlife or wildlife remains.
2020 SECTION 2. The changes in law made by this Act apply only to
2121 an offense committed on or after the effective date of this Act. An
2222 offense committed before the effective date of this Act is covered
2323 by the law in effect when the offense was committed, and the former
2424 law is continued in effect for that purpose. For purposes of this
2525 section, an offense was committed before the effective date of this
2626 Act if any element of the offense was committed before that date.
2727 SECTION 3. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2013.
