66 AN ACT
77 relating to an exemption from registration and regulation
88 requirements for steam cookers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 755.001, Health and Safety Code, is
1111 amended by adding Subdivision (23-a) to read as follows:
1212 (23-a) "Steam cooker" means a steam heating boiler
1313 that is:
1414 (A) designed to steam cook food;
1515 (B) operated at a pressure not exceeding five
1616 pounds per square inch; and
1717 (C) equipped with a safety appliance operated at
1818 a pressure not exceeding five pounds per square inch.
1919 SECTION 2. Section 755.022(a), Health and Safety Code, is
2020 amended to read as follows:
2121 (a) This chapter does not apply to:
2222 (1) boilers owned or operated by the federal
2323 government;
2424 (2) pressure vessels or process steam generators,
2525 other than steam collection or liberation drums of process steam
2626 generators;
2727 (3) manually fired miniature boilers that:
2828 (A) are constructed or maintained for
2929 locomotives, boats, tractors, or stationary engines only as a hobby
3030 for exhibition, recreation, education, or historical purposes and
3131 not for commercial use;
3232 (B) have an inside diameter of 12 inches or less
3333 or a grate area of two square feet or less; and
3434 (C) are equipped with a safety valve of adequate
3535 size, a water level indicator, and a pressure gauge; [or]
3636 (4) boilers that are designed for operation only at
3737 atmospheric pressure and that are equipped with two independent
3838 means to prevent the buildup of pressure; or
3939 (5) steam cookers.
4040 SECTION 3. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2013.
