| 7 | 7 | | relating to an exemption from registration and regulation |

| 8 | 8 | | requirements for steam cookers. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 755.001, Health and Safety Code, is |
|---|
| 11 | 11 | | amended by adding Subdivision (23-a) to read as follows: |
|---|
| 12 | 12 | | (23-a) "Steam cooker" means a steam heating boiler |
|---|
| 13 | 13 | | that is: |
|---|
| 14 | 14 | | (A) designed to steam cook food; |
|---|
| 15 | 15 | | (B) operated at a pressure not exceeding five |
|---|
| 16 | 16 | | pounds per square inch; and |
|---|
| 17 | 17 | | (C) equipped with a safety appliance operated at |
|---|
| 18 | 18 | | a pressure not exceeding five pounds per square inch. |
|---|
| 19 | 19 | | SECTION 2. Section 755.022(a), Health and Safety Code, is |
|---|
| 20 | 20 | | amended to read as follows: |
|---|
| 21 | 21 | | (a) This chapter does not apply to: |
|---|
| 22 | 22 | | (1) boilers owned or operated by the federal |
|---|
| 23 | 23 | | government; |
|---|
| 24 | 24 | | (2) pressure vessels or process steam generators, |
|---|
| 25 | 25 | | other than steam collection or liberation drums of process steam |
|---|
| 26 | 26 | | generators; |
|---|
| 27 | 27 | | (3) manually fired miniature boilers that: |
|---|
| 28 | 28 | | (A) are constructed or maintained for |
|---|
| 29 | 29 | | locomotives, boats, tractors, or stationary engines only as a hobby |
|---|
| 30 | 30 | | for exhibition, recreation, education, or historical purposes and |
|---|
| 31 | 31 | | not for commercial use; |
|---|
| 32 | 32 | | (B) have an inside diameter of 12 inches or less |
|---|
| 33 | 33 | | or a grate area of two square feet or less; and |
|---|
| 34 | 34 | | (C) are equipped with a safety valve of adequate |
|---|
| 35 | 35 | | size, a water level indicator, and a pressure gauge; [or] |
|---|
| 36 | 36 | | (4) boilers that are designed for operation only at |
|---|
| 37 | 37 | | atmospheric pressure and that are equipped with two independent |
|---|
| 38 | 38 | | means to prevent the buildup of pressure; or |
|---|
| 39 | 39 | | (5) steam cookers. |
|---|
| 40 | 40 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 44 | 44 | | Act takes effect September 1, 2013. |
