99 inexperienced or uncertified teacher.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 7.056(e), Education Code, is amended to
1212 read as follows:
1313 (e) Except as provided by Subsection (f), a school campus or
1414 district may not receive an exemption or waiver under this section
1515 from:
1616 (1) a prohibition on conduct that constitutes a
1717 criminal offense;
1818 (2) a requirement imposed by federal law or rule,
1919 including a requirement for special education or bilingual
2020 education programs; or
2121 (3) a requirement, restriction, or prohibition
2222 relating to:
2323 (A) essential knowledge or skills under Section
2424 28.002 or high school graduation requirements under Section 28.025;
2525 (B) public school accountability as provided by
2626 Subchapters B, C, D, E, and J, Chapter 39;
2727 (C) extracurricular activities under Section
2828 33.081 or participation in a University Interscholastic League
2929 area, regional, or state competition under Section 33.0812;
3030 (D) health and safety under Chapter 38;
3131 (E) purchasing under Subchapter B, Chapter 44;
3232 (F) elementary school class size limits, except
3333 as provided by Section 25.112;
3434 (G) removal of a disruptive student from the
3535 classroom under Subchapter A, Chapter 37;
3636 (H) at-risk programs under Subchapter C, Chapter
3737 29;
3838 (I) prekindergarten programs under Subchapter E,
3939 Chapter 29;
4040 (J) educator rights and benefits under
4141 Subchapters A, C, D, E, F, G, and I, Chapter 21, or under Subchapter
4242 A, Chapter 22;
4343 (K) special education programs under Subchapter
4444 A, Chapter 29;
4545 (L) bilingual education programs under
4646 Subchapter B, Chapter 29; [or]
4747 (M) the requirements for the first day of
4848 instruction under Section 25.0811; or
4949 (N) assignment of a student to a teacher under
5050 Section 28.0215, except as provided by Subsection (e) of that
5151 section.
5252 SECTION 2. Subchapter B, Chapter 28, Education Code, is
5353 amended by adding Section 28.0215 to read as follows:
5454 Sec. 28.0215. REQUIREMENTS FOR ASSIGNMENT OF STUDENTS TO
5555 TEACHERS. (a) This section applies only to a school district with
5656 an enrollment of 5,000 or more students.
5757 (b) A student in kindergarten through grade six who attends
5858 an elementary school may not be assigned for two consecutive school
5959 years to a teacher who:
6060 (1) has less than one year of teaching experience; or
6161 (2) does not hold the appropriate certificate required
6262 under Section 21.003.
6363 (c) The requirement imposed by Subsection (b) does not apply
6464 if the student's parent or other person standing in parental
6565 relation to the student and a school counselor or school
6666 administrator agree otherwise regarding assignment of the student
6767 to a teacher.
6868 (d) Subsection (b) does not apply to the first year a
6969 student transfers into a school district.
7070 (e) The commissioner may grant a waiver from the
7171 requirements of this section to a school district if the
7272 commissioner finds that extreme circumstances in the district
7373 warrant the waiver. The commissioner may adopt rules as necessary
7474 to implement this section.
7575 SECTION 3. This Act applies beginning with the 2013-2014
7676 school year.
7777 SECTION 4. This Act takes effect immediately if it receives
7878 a vote of two-thirds of all the members elected to each house, as
7979 provided by Section 39, Article III, Texas Constitution. If this
8080 Act does not receive the vote necessary for immediate effect, this
8181 Act takes effect September 1, 2013.
