| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 7.056(e), Education Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (e) Except as provided by Subsection (f), a school campus or |
|---|
| 14 | 14 | | district may not receive an exemption or waiver under this section |
|---|
| 15 | 15 | | from: |
|---|
| 16 | 16 | | (1) a prohibition on conduct that constitutes a |
|---|
| 17 | 17 | | criminal offense; |
|---|
| 18 | 18 | | (2) a requirement imposed by federal law or rule, |
|---|
| 19 | 19 | | including a requirement for special education or bilingual |
|---|
| 20 | 20 | | education programs; or |
|---|
| 21 | 21 | | (3) a requirement, restriction, or prohibition |
|---|
| 22 | 22 | | relating to: |
|---|
| 23 | 23 | | (A) essential knowledge or skills under Section |
|---|
| 24 | 24 | | 28.002 or high school graduation requirements under Section 28.025; |
|---|
| 25 | 25 | | (B) public school accountability as provided by |
|---|
| 26 | 26 | | Subchapters B, C, D, E, and J, Chapter 39; |
|---|
| 27 | 27 | | (C) extracurricular activities under Section |
|---|
| 28 | 28 | | 33.081 or participation in a University Interscholastic League |
|---|
| 29 | 29 | | area, regional, or state competition under Section 33.0812; |
|---|

| 52 | 52 | | SECTION 2. Subchapter B, Chapter 28, Education Code, is |
|---|
| 53 | 53 | | amended by adding Section 28.0215 to read as follows: |
|---|
| 54 | 54 | | Sec. 28.0215. REQUIREMENTS FOR ASSIGNMENT OF STUDENTS TO |
|---|
| 55 | 55 | | TEACHERS. (a) This section applies only to a school district with |
|---|
| 56 | 56 | | an enrollment of 5,000 or more students. |
|---|
| 57 | 57 | | (b) A student in kindergarten through grade six who attends |
|---|
| 58 | 58 | | an elementary school may not be assigned for two consecutive school |
|---|
| 59 | 59 | | years to a teacher who: |
|---|
| 60 | 60 | | (1) has less than one year of teaching experience; or |
|---|
| 61 | 61 | | (2) does not hold the appropriate certificate required |
|---|
| 62 | 62 | | under Section 21.003. |
|---|
| 63 | 63 | | (c) The requirement imposed by Subsection (b) does not apply |
|---|
| 64 | 64 | | if the student's parent or other person standing in parental |
|---|
| 65 | 65 | | relation to the student and a school counselor or school |
|---|
| 66 | 66 | | administrator agree otherwise regarding assignment of the student |
|---|
| 67 | 67 | | to a teacher. |
|---|
| 68 | 68 | | (d) Subsection (b) does not apply to the first year a |
|---|
| 69 | 69 | | student transfers into a school district. |
|---|
| 70 | 70 | | (e) The commissioner may grant a waiver from the |
|---|
| 71 | 71 | | requirements of this section to a school district if the |
|---|
| 72 | 72 | | commissioner finds that extreme circumstances in the district |
|---|
| 73 | 73 | | warrant the waiver. The commissioner may adopt rules as necessary |
|---|
| 74 | 74 | | to implement this section. |
|---|
| 75 | 75 | | SECTION 3. This Act applies beginning with the 2013-2014 |
|---|
| 76 | 76 | | school year. |
|---|
| 77 | 77 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 78 | 78 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 79 | 79 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 80 | 80 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 81 | 81 | | Act takes effect September 1, 2013. |
