99 AN ACT
1010 relating to the creation of the Montgomery County Municipal Utility
1111 District No. 132; providing authority to impose a tax and issue
1212 bonds; granting a limited power of eminent domain.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1515 Code, is amended by adding Chapter 8414 to read as follows:
1616 CHAPTER 8414. MONTGOMERY COUNTY MUNICIPAL UTILITY DISTRICT
1717 NO. 132
1818 SUBCHAPTER A. GENERAL PROVISIONS
1919 Sec. 8414.001. DEFINITIONS. In this chapter:
2020 (1) "Board" means the district's board of directors.
2121 (2) "Commission" means the Texas Commission on
2222 Environmental Quality.
2323 (3) "Director" means a board member.
2424 (4) "District" means the Montgomery County Municipal
2525 Utility District No. 132.
2626 Sec. 8414.002. NATURE OF DISTRICT. The district is a
2727 municipal utility district created under Section 59, Article XVI,
2828 Texas Constitution.
2929 Sec. 8414.003. CONFIRMATION AND DIRECTORS' ELECTION
3030 REQUIRED. The temporary directors shall hold an election to
3131 confirm the creation of the district and to elect five permanent
3232 directors as provided by Section 49.102, Water Code.
3333 Sec. 8414.004. CONSENT OF MUNICIPALITY REQUIRED. The
3434 temporary directors may not hold an election under Section 8414.003
3535 until each municipality in whose corporate limits or
3636 extraterritorial jurisdiction the district is located has
3737 consented by ordinance or resolution to the creation of the
3838 district and to the inclusion of land in the district.
3939 Sec. 8414.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
4040 The district is created to serve a public purpose and benefit.
4141 (b) The district is created to accomplish the purposes of:
4242 (1) a municipal utility district as provided by
4343 general law and Section 59, Article XVI, Texas Constitution; and
4444 (2) Section 52, Article III, Texas Constitution, that
4545 relate to the construction, acquisition, improvement, operation,
4646 or maintenance of macadamized, graveled, or paved roads, or
4747 improvements, including storm drainage, in aid of those roads.
4848 Sec. 8414.006. INITIAL DISTRICT TERRITORY. (a) The
4949 district is initially composed of the territory described by
5050 Section 2 of the Act enacting this chapter.
5151 (b) The boundaries and field notes contained in Section 2 of
5252 the Act enacting this chapter form a closure. A mistake made in the
5353 field notes or in copying the field notes in the legislative process
5454 does not affect the district's:
5555 (1) organization, existence, or validity;
5656 (2) right to issue any type of bond for the purposes
5757 for which the district is created or to pay the principal of and
5858 interest on a bond;
5959 (3) right to impose a tax; or
6060 (4) legality or operation.
6161 Sec. 8414.007. ELIGIBILITY FOR INCLUSION IN TAX INCREMENT
6262 REINVESTMENT ZONE. (a) The district is eligible to be included in
6363 a tax increment reinvestment zone created under Chapter 311, Tax
6464 Code.
6565 (b) If the City of Conroe has created or creates a tax
6666 increment reinvestment zone described by Subsection (a) that
6767 includes all or part of the territory of the district, the City of
6868 Conroe and the board of directors of the zone or a developer of
6969 property within the tax increment reinvestment zone that receives
7070 or will receive money from the tax increment fund, by contract with
7171 the district, may grant money to the district from the tax increment
7272 fund to be used for a permissible purpose of the district,
7373 including:
7474 (1) the right to pledge the money as security for a
7575 bond or other obligation issued by the district; and
7676 (2) any permissible purpose of a corporation under
7777 Section 380.002(b), Local Government Code.
7878 SUBCHAPTER B. BOARD OF DIRECTORS
7979 Sec. 8414.051. GOVERNING BODY; TERMS. (a) The district is
8080 governed by a board of five elected directors.
8181 (b) Except as provided by Section 8414.052, directors serve
8282 staggered four-year terms.
8383 Sec. 8414.052. TEMPORARY DIRECTORS. (a) The temporary
8484 board consists of:
8585 (1) Bill Odle;
8686 (2) Brandon Macey;
8787 (3) Troy Koteras;
8888 (4) Greg Snider; and
8989 (5) Abby McMahon.
9090 (b) Temporary directors serve until the earlier of:
9191 (1) the date permanent directors are elected under
9292 Section 8414.003; or
9393 (2) the fourth anniversary of the effective date of
9494 the Act enacting this chapter.
9595 (c) If permanent directors have not been elected under
9696 Section 8414.003 and the terms of the temporary directors have
9797 expired, successor temporary directors shall be appointed or
9898 reappointed as provided by Subsection (d) to serve terms that
9999 expire on the earlier of:
100100 (1) the date permanent directors are elected under
101101 Section 8414.003; or
102102 (2) the fourth anniversary of the date of the
103103 appointment or reappointment.
104104 (d) If Subsection (c) applies, the owner or owners of a
105105 majority of the assessed value of the real property in the district
106106 may submit a petition to the commission requesting that the
107107 commission appoint as successor temporary directors the five
108108 persons named in the petition. The commission shall appoint as
109109 successor temporary directors the five persons named in the
110110 petition.
111111 SUBCHAPTER C. POWERS AND DUTIES
112112 Sec. 8414.101. GENERAL POWERS AND DUTIES. The district has
113113 the powers and duties necessary to accomplish the purposes for
114114 which the district is created.
115115 Sec. 8414.102. MUNICIPAL UTILITY DISTRICT POWERS AND
116116 DUTIES. The district has the powers and duties provided by the
117117 general law of this state, including Chapters 49 and 54, Water Code,
118118 applicable to municipal utility districts created under Section 59,
119119 Article XVI, Texas Constitution.
120120 Sec. 8414.103. AUTHORITY FOR ROAD PROJECTS. Under Section
121121 52, Article III, Texas Constitution, the district may design,
122122 acquire, construct, finance, issue bonds for, improve, operate,
123123 maintain, and convey to this state, a county, or a municipality for
124124 operation and maintenance macadamized, graveled, or paved roads, or
125125 improvements, including storm drainage, in aid of those roads.
126126 Sec. 8414.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
127127 project must meet all applicable construction standards, zoning and
128128 subdivision requirements, and regulations of each municipality in
129129 whose corporate limits or extraterritorial jurisdiction the road
130130 project is located.
131131 (b) If a road project is not located in the corporate limits
132132 or extraterritorial jurisdiction of a municipality, the road
133133 project must meet all applicable construction standards,
134134 subdivision requirements, and regulations of each county in which
135135 the road project is located.
136136 (c) If the state will maintain and operate the road, the
137137 Texas Transportation Commission must approve the plans and
138138 specifications of the road project.
139139 Sec. 8414.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
140140 OR RESOLUTION. (a) The district shall comply with all applicable
141141 requirements of any ordinance or resolution that is adopted under
142142 Section 54.016 or 54.0165, Water Code, and that consents to the
143143 creation of the district or to the inclusion of land in the
144144 district.
145145 (b) In addition to all the rights and remedies provided by
146146 other law, if the district violates the terms of an ordinance or
147147 resolution described by Subsection (a), the municipality is
148148 entitled to injunctive relief or a writ of mandamus issued by a
149149 court requiring the district and the district's officials to
150150 observe and comply with the terms of the ordinance or resolution.
151151 Sec. 8414.106. EFFECT OF ANNEXATION OR INCLUSION WITHIN THE
152152 CORPORATE BOUNDARIES OF THE CITY OF CONROE. Notwithstanding Section
153153 54.016(f)(2), Water Code, an allocation agreement between the City
154154 of Conroe and the district that provides for the allocation of the
155155 taxes or revenues of the district and the city following the date of
156156 inclusion of all the district's territory in the corporate limits
157157 of the city may provide that the total annual ad valorem taxes
158158 collected by the city and the district from taxable property in the
159159 district may exceed the city's ad valorem tax on that property.
160160 Sec. 8414.107. LIMITATION ON USE OF EMINENT DOMAIN. The
161161 district may not exercise the power of eminent domain outside the
162162 district without the written consent of the City of Conroe.
163163 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
164164 Sec. 8414.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
165165 district may issue, without an election, bonds and other
166166 obligations secured by revenue other than ad valorem taxes.
167167 (b) The district must hold an election in the manner
168168 provided by Chapters 49 and 54, Water Code, to obtain voter approval
169169 before the district may impose an ad valorem tax or issue bonds
170170 payable from ad valorem taxes.
171171 (c) The district may not issue bonds payable from ad valorem
172172 taxes to finance a road project unless the issuance is approved by a
173173 vote of a two-thirds majority of the district voters voting at an
174174 election held for that purpose.
175175 Sec. 8414.152. OPERATION AND MAINTENANCE TAX. (a) If
176176 authorized at an election held under Section 8414.151, the district
177177 may impose an operation and maintenance tax on taxable property in
178178 the district in accordance with Section 49.107, Water Code.
179179 (b) The board shall determine the tax rate. The rate may not
180180 exceed the rate approved at the election.
181181 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
182182 Sec. 8414.201. AUTHORITY TO ISSUE BONDS AND OTHER
183183 OBLIGATIONS. The district may issue bonds or other obligations
184184 payable wholly or partly from ad valorem taxes, impact fees,
185185 revenue, contract payments, tax increment payments, grants, or
186186 other district money, or any combination of those sources, to pay
187187 for any authorized district purpose.
188188 Sec. 8414.202. TAXES FOR BONDS. At the time the district
189189 issues bonds payable wholly or partly from ad valorem taxes, the
190190 board shall provide for the annual imposition of a continuing
191191 direct ad valorem tax, without limit as to rate or amount, while all
192192 or part of the bonds are outstanding as required and in the manner
193193 provided by Sections 54.601 and 54.602, Water Code.
194194 Sec. 8414.203. BONDS FOR ROAD PROJECTS. At the time of
195195 issuance, the total principal amount of bonds or other obligations
196196 issued or incurred to finance road projects and payable from ad
197197 valorem taxes may not exceed one-fourth of the assessed value of the
198198 real property in the district.
199199 SECTION 2. Montgomery County Municipal Utility District No.
200200 132 initially includes all the territory contained in the following
201201 area: TRACT I (23.69 acres):
202202 Metes and bounds description of all that certain 23.69 acre tract or
203203 parcel of land, lying and being situated in the John McDillon
204204 Survey, A-347, Conroe, Montgomery County, Texas, and being a
205205 portion out of that same 57.98 acre tract conveyed to Wedgewood
206206 Falls, Ltd., as described by deed recorded in Volume 589.10, Page
207207 1036 of the Deed of Records of Montgomery County ("DRMC") and also
208208 being formerly referred to as "Tract III", as depicted on drawing
209209 entitled "Composite Map of 135.750 Acres", said 23.69 acre tract
210210 being more particularly described as follows:
211211 BEGINNING at a 1/2" iron rod found for the northwest corner of this
212212 tract, being also the northwest corner of said 57.98 acre tract, and
213213 lying in the south line of the P.H. Herndon Survey, A-256 and also
214214 being in the south line of the Aaron Pasternak Estate (No Citation);
215215 THENCE N 72° 13' 41" E - 526.41 feet with the said common line to a
216216 plastic capped 1/2" iron (stamped Taggart, RPLS #5676) found for
217217 the northeasterly corner of this tract and being in the westerly
218218 right-of-way line of Longmire Road (variable width ROW), a public

488488 SECTION 3. (a) The legal notice of the intention to
489489 introduce this Act, setting forth the general substance of this
490490 Act, has been published as provided by law, and the notice and a
491491 copy of this Act have been furnished to all persons, agencies,
492492 officials, or entities to which they are required to be furnished
493493 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
494494 Government Code.
495495 (b) The governor, one of the required recipients, has
496496 submitted the notice and Act to the Texas Commission on
497497 Environmental Quality.
498498 (c) The Texas Commission on Environmental Quality has filed
499499 its recommendations relating to this Act with the governor, the
500500 lieutenant governor, and the speaker of the house of
501501 representatives within the required time.
502502 (d) All requirements of the constitution and laws of this
503503 state and the rules and procedures of the legislature with respect
504504 to the notice, introduction, and passage of this Act are fulfilled
505505 and accomplished.
506506 SECTION 4. (a) Section 8414.107, Special District Local
507507 Laws Code, as added by Section 1 of this Act, takes effect only if
508508 this Act receives a two-thirds vote of all the members elected to
509509 each house.
510510 (b) If this Act does not receive a two-thirds vote of all the
511511 members elected to each house, Subchapter C, Chapter 8414, Special
512512 District Local Laws Code, as added by Section 1 of this Act, is
513513 amended by adding Section 8414.107 to read as follows:
514514 Sec. 8414.107. NO EMINENT DOMAIN POWER. The district may
515515 not exercise the power of eminent domain.
516516 (c) This section is not intended to be an expression of a
517517 legislative interpretation of the requirements of Section 17(c),
518518 Article I, Texas Constitution.
519519 SECTION 5. This Act takes effect immediately if it receives
520520 a vote of two-thirds of all the members elected to each house, as
521521 provided by Section 39, Article III, Texas Constitution. If this
522522 Act does not receive the vote necessary for immediate effect, this
523523 Act takes effect September 1, 2013.
