77 relating to municipal regulation of electric stun guns, knives, and
88 personal defense sprays.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Subchapter A, Chapter 229, Local
1111 Government Code, is amended to read as follows:
1212 SUBCHAPTER A. REGULATION OF WEAPONS [FIREARMS] AND EXPLOSIVES
1313 SECTION 2. Subchapter A, Chapter 229, Local Government
1414 Code, is amended by adding Section 229.005 to read as follows:
1515 Sec. 229.005. ELECTRIC STUN GUNS; KNIVES; PERSONAL DEFENSE
1616 SPRAYS. (a) In this section:
1717 (1) "Electric stun gun" means a device that is:
1818 (A) sold commercially for personal protection;
1919 and
2020 (B) designed, made, or adapted for the purpose of
2121 emitting an electrical charge or current intended to temporarily
2222 disable a person.
2323 (2) "Knife" has the meaning assigned by Section 46.01,
2424 Penal Code.
2525 (3) "Personal defense spray" means a small chemical
2626 dispenser that is:
2727 (A) sold commercially for personal protection;
2828 and
2929 (B) designed, made, or adapted for the purpose of
3030 dispensing a substance capable of causing an adverse psychological
3131 or physiological effect on a human being.
3232 (b) Notwithstanding any other law, a municipality may not
3333 adopt or enforce an ordinance or other regulation relating to the
3434 private ownership, keeping, carrying, transportation, licensing,
3535 or registration of an electric stun gun, a knife, or a personal
3636 defense spray.
3737 (c) Subsection (b) does not affect the authority of a
3838 municipality to:
3939 (1) enforce Sections 46.02, 46.03, and 46.05, Penal
4040 Code; or
4141 (2) adopt or enforce an ordinance or other regulation
4242 prohibiting a person, for purposes of entering a restricted area,
4343 from carrying an electric stun gun, a knife, or a personal defense
4444 spray past a metal detector or magnetometer used to screen for
4545 weapons.
4646 SECTION 3. This Act takes effect September 1, 2013.
