| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Subchapter A, Chapter 229, Local |
|---|
| 11 | 11 | | Government Code, is amended to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER A. REGULATION OF WEAPONS [FIREARMS] AND EXPLOSIVES |
|---|
| 13 | 13 | | SECTION 2. Subchapter A, Chapter 229, Local Government |
|---|
| 14 | 14 | | Code, is amended by adding Section 229.005 to read as follows: |
|---|
| 15 | 15 | | Sec. 229.005. ELECTRIC STUN GUNS; KNIVES; PERSONAL DEFENSE |
|---|
| 16 | 16 | | SPRAYS. (a) In this section: |
|---|
| 17 | 17 | | (1) "Electric stun gun" means a device that is: |
|---|
| 18 | 18 | | (A) sold commercially for personal protection; |
|---|
| 19 | 19 | | and |
|---|
| 20 | 20 | | (B) designed, made, or adapted for the purpose of |
|---|
| 21 | 21 | | emitting an electrical charge or current intended to temporarily |
|---|
| 22 | 22 | | disable a person. |
|---|
| 23 | 23 | | (2) "Knife" has the meaning assigned by Section 46.01, |
|---|
| 24 | 24 | | Penal Code. |
|---|
| 25 | 25 | | (3) "Personal defense spray" means a small chemical |
|---|
| 26 | 26 | | dispenser that is: |
|---|
| 27 | 27 | | (A) sold commercially for personal protection; |
|---|
| 28 | 28 | | and |
|---|
| 29 | 29 | | (B) designed, made, or adapted for the purpose of |
|---|
| 30 | 30 | | dispensing a substance capable of causing an adverse psychological |
|---|
| 31 | 31 | | or physiological effect on a human being. |
|---|
| 32 | 32 | | (b) Notwithstanding any other law, a municipality may not |
|---|
| 33 | 33 | | adopt or enforce an ordinance or other regulation relating to the |
|---|
| 34 | 34 | | private ownership, keeping, carrying, transportation, licensing, |
|---|
| 35 | 35 | | or registration of an electric stun gun, a knife, or a personal |
|---|
| 36 | 36 | | defense spray. |
|---|
| 37 | 37 | | (c) Subsection (b) does not affect the authority of a |
|---|
| 38 | 38 | | municipality to: |
|---|
| 39 | 39 | | (1) enforce Sections 46.02, 46.03, and 46.05, Penal |
|---|
| 40 | 40 | | Code; or |
|---|
| 41 | 41 | | (2) adopt or enforce an ordinance or other regulation |
|---|
| 42 | 42 | | prohibiting a person, for purposes of entering a restricted area, |
|---|
| 43 | 43 | | from carrying an electric stun gun, a knife, or a personal defense |
|---|
| 44 | 44 | | spray past a metal detector or magnetometer used to screen for |
|---|
| 45 | 45 | | weapons. |

| 46 | 46 | | SECTION 3. This Act takes effect September 1, 2013. |
