99 relating to the dissemination of criminal history record
1010 information by the Department of Public Safety concerning the
1111 offense of intoxication manslaughter.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 411.135(a), Government Code, is amended
1414 to read as follows:
1515 (a) Any person is entitled to obtain from the department:
1616 (1) any information described as public information
1717 under Chapter 62, Code of Criminal Procedure, [as added by Chapter
1818 668, Acts of the 75th Legislature, Regular Session, 1997,]
1919 including, to the extent available, a recent photograph of each
2020 person subject to registration under that chapter; [and]
2121 (2) criminal history record information maintained by
2222 the department that relates to the conviction of or a grant of
2323 deferred adjudication to a person for any criminal offense,
2424 including arrest information that relates to the conviction or
2525 grant of deferred adjudication; and
2626 (3) any information described as public information
2727 under Section 411.1356(a).
2828 SECTION 2. Subchapter F, Chapter 411, Government Code, is
2929 amended by adding Sections 411.1356 and 411.1357 to read as
3030 follows:
3131 Sec. 411.1356. PUBLIC ACCESS TO CRIMINAL HISTORY RECORD
3232 INFORMATION CONCERNING OFFENSE OF INTOXICATION MANSLAUGHTER. (a)
3333 Criminal history record information that concerns a person's
3434 conviction within the preceding 10-year period for an offense under
3535 Section 49.08, Penal Code, is public information, with the
3636 exception of:
3737 (1) any information regarding the person's social
3838 security number, driver's license number, or telephone number; and
3939 (2) any information that would identify a victim of
4040 the offense.
4141 (b) The department shall implement and maintain an Internet
4242 website to allow any person, free of charge, to electronically
4343 search for and receive information described by Subsection (a).
4444 The website must be searchable by zip code, city, county, or the
4545 name of the person convicted. The search results must include for
4646 each person convicted:
4747 (1) the person's full name and last known address; and
4848 (2) a recent photograph of the person, if a photograph
4949 is available to the department.
5050 (c) The department shall remove the criminal history record
5151 information concerning a person's conviction for an offense under
5252 Section 49.08, Penal Code, from the Internet website as soon as
5353 practicable after the earliest of:
5454 (1) the 10th anniversary of the date of the
5555 conviction;
5656 (2) the date on which the conviction is reversed on
5757 appeal; or
5858 (3) the date on which an order of expunction is entered
5959 with respect to records and files in the case.
6060 Sec. 411.1357. CRIMINAL HISTORY RECORD INFORMATION
6161 CONCERNING OFFENSE OF INTOXICATION MANSLAUGHTER PROVIDED TO PEACE
6262 OFFICER ON REQUEST. (a) The department shall establish a procedure
6363 by which a peace officer or employee of a law enforcement agency who
6464 provides the department with a driver's license number, personal
6565 identification certificate number, or license plate number may be
6666 provided any criminal history record information maintained by the
6767 department concerning a conviction of the person to whom the
6868 license, certificate, or plate is issued for an offense under
6969 Section 49.08, Penal Code, within the preceding 10-year period.
7070 (b) The procedure established under Subsection (a) must
7171 allow a peace officer to request the information from the location
7272 of a motor vehicle stop and to receive a response to the request
7373 within the duration of a reasonable motor vehicle stop.
7474 SECTION 3. Not later than May 1, 2014, the Department of
7575 Public Safety shall implement the Internet website required under
7676 Section 411.1356, Government Code, as added by this Act, and shall
7777 make available to a requesting person the information described by
7878 Section 411.1356 or 411.1357, Government Code, as added by this
7979 Act.
8080 SECTION 4. This Act takes effect September 1, 2013.
