77 relating to the date on which certain criminal defendants are
88 eligible to file a petition for an order of nondisclosure.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 411.081(d), Government Code, is amended
1111 to read as follows:
1212 (d) Notwithstanding any other provision of this subchapter,
1313 if a person is placed on deferred adjudication community
1414 supervision under Section 5, Article 42.12, Code of Criminal
1515 Procedure, subsequently receives a discharge and dismissal under
1616 Section 5(c), Article 42.12, and satisfies the requirements of
1717 Subsection (e), the person may petition the court that placed the
1818 defendant on deferred adjudication for an order of nondisclosure
1919 under this subsection. Except as provided by Subsection (e), a
2020 person may petition the court under this subsection regardless of
2121 whether the person has been previously placed on deferred
2222 adjudication community supervision for another offense. After
2323 notice to the state and a hearing on whether the person is entitled
2424 to file the petition and issuance of the order is in the best
2525 interest of justice, the court shall issue an order prohibiting
2626 criminal justice agencies from disclosing to the public criminal
2727 history record information related to the offense giving rise to
2828 the deferred adjudication. A criminal justice agency may disclose
2929 criminal history record information that is the subject of the
3030 order only to other criminal justice agencies, for criminal justice
3131 or regulatory licensing purposes, an agency or entity listed in
3232 Subsection (i), or the person who is the subject of the order. A
3333 person may petition the court that placed the person on deferred
3434 adjudication for an order of nondisclosure on payment of a $28 fee
3535 to the clerk of the court in addition to any other fee that
3636 generally applies to the filing of a civil petition. The payment
3737 may be made only on or after:
3838 (1) the discharge and dismissal, if the offense for
3939 which the person was placed on deferred adjudication was a
4040 misdemeanor other than a misdemeanor described by Subdivision (2);
4141 (2) the first [second] anniversary of the discharge
4242 and dismissal, if the offense for which the person was placed on
4343 deferred adjudication was a misdemeanor under Chapter 20, 21, 22,
4444 25, 42, or 46, Penal Code; or
4545 (3) the third [fifth] anniversary of the discharge and
4646 dismissal, if the offense for which the person was placed on
4747 deferred adjudication was a felony.
4848 SECTION 2. The change in law made by this Act in amending
4949 Section 411.081, Government Code, applies to a person who petitions
5050 the court for an order of nondisclosure on or after the effective
5151 date of this Act, regardless of whether the person is placed on
5252 deferred adjudication community supervision before, on, or after
5353 that date.
5454 SECTION 3. This Act takes effect September 1, 2013.
