| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 130.010, Education Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | Sec. 130.010. PURCHASING CONTRACTS. (a) Except as |
|---|
| 15 | 15 | | provided by Subsection (c), the [The] provisions of Subchapter B, |
|---|
| 16 | 16 | | Chapter 44, relating to the purchase of goods and services under |
|---|
| 17 | 17 | | contract by a school district apply to the purchase of goods and |
|---|
| 18 | 18 | | services under contract by a junior college district. |
|---|
| 19 | 19 | | (b) To the extent of any conflict, the provisions of this |
|---|
| 20 | 20 | | section and Subchapter B, Chapter 44, prevail over any other law |
|---|
| 21 | 21 | | relating to the purchase of goods and services by a junior college |
|---|
| 22 | 22 | | district. |
|---|
| 23 | 23 | | (c) A junior college district, in awarding a contract by |
|---|
| 24 | 24 | | competitive sealed bid, may consider the location of a bidder's |
|---|
| 25 | 25 | | principal place of business in the manner provided by Sections |
|---|
| 26 | 26 | | 271.905 and 271.9051, Local Government Code. This subsection does |
|---|
| 27 | 27 | | not apply to the purchase of advanced communications services, |
|---|
| 28 | 28 | | information service, or telecommunications service, as those terms |
|---|
| 29 | 29 | | are defined by 47 U.S.C. Section 153. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2013. |
