88 AN ACT
99 relating to consideration of a bidder's principal place of business
1010 by public junior college districts in awarding certain contracts.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 130.010, Education Code, is amended to
1313 read as follows:
1414 Sec. 130.010. PURCHASING CONTRACTS. (a) Except as
1515 provided by Subsection (c), the [The] provisions of Subchapter B,
1616 Chapter 44, relating to the purchase of goods and services under
1717 contract by a school district apply to the purchase of goods and
1818 services under contract by a junior college district.
1919 (b) To the extent of any conflict, the provisions of this
2020 section and Subchapter B, Chapter 44, prevail over any other law
2121 relating to the purchase of goods and services by a junior college
2222 district.
2323 (c) A junior college district, in awarding a contract by
2424 competitive sealed bid, may consider the location of a bidder's
2525 principal place of business in the manner provided by Sections
2626 271.905 and 271.9051, Local Government Code. This subsection does
2727 not apply to the purchase of advanced communications services,
2828 information service, or telecommunications service, as those terms
2929 are defined by 47 U.S.C. Section 153.
3030 SECTION 2. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2013.
