| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter C, Chapter 21, Transportation Code, |
|---|
| 14 | 14 | | is amended by adding Section 21.115 to read as follows: |

| 15 | 15 | | Sec. 21.115. FUNDING FOR CERTAIN COMMERCIAL SERVICE |
|---|
| 16 | 16 | | AIRPORTS. To the extent consistent with federal funding |
|---|
| 17 | 17 | | restrictions, a project involving a commercial service airport is |
|---|
| 18 | 18 | | eligible for financial assistance under this subchapter, including |
|---|
| 19 | 19 | | for inclusion in the aviation facilities capital improvement |
|---|
| 20 | 20 | | program, if the airport is located in a county along the |
|---|
| 21 | 21 | | Texas-Mexico border that has a population of less than 300,000. |

| 22 | 22 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 26 | | Act takes effect September 1, 2013. |
