99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the authority of a county to deposit fees collected by a
1212 county bail bond board in a separate county fund.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 1704.101, Occupations Code, is amended
1515 to read as follows:
1616 Sec. 1704.101. ADMINISTRATIVE AUTHORITY. A board shall:
1717 (1) exercise powers incidental or necessary to the
1818 administration of this chapter;
1919 (2) deposit fees collected under this chapter in the
2020 general fund of the county or in a separate county fund established
2121 for this purpose;
2222 (3) supervise and regulate each phase of the bonding
2323 business in the county;
2424 (4) adopt and post rules necessary to implement this
2525 chapter;
2626 (5) conduct hearings and investigations and make
2727 determinations relating to the issuance, denial, or renewal of
2828 licenses;
2929 (6) issue licenses to qualified applicants;
3030 (7) deny licenses to unqualified applicants;
3131 (8) employ persons necessary to assist in board
3232 functions; and
3333 (9) conduct board business, including maintaining
3434 records and minutes.
3535 SECTION 2. Section 1704.103(a), Occupations Code, is
3636 amended to read as follows:
3737 (a) Fees deposited in the general fund of a county or in a
3838 separate county fund under Section 1704.101(2) may be used only to
3939 administer and enforce this chapter, including reimbursement for:
4040 (1) reasonable expenses incurred by the board in
4141 enforcing this chapter; and
4242 (2) actual expenses incurred by a board member in
4343 serving on the board.
4444 SECTION 3. A county that establishes a separate county fund
4545 for the purpose of depositing fees collected under Chapter 1704,
4646 Occupations Code, as provided by Section 1704.101, Occupations
4747 Code, as amended by this Act, may transfer fees previously
4848 collected under Chapter 1704, Occupations Code, and deposited in
4949 the county's general fund to the separate fund.
5050 SECTION 4. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2013.
