A BILL TO BE ENTITLED
AN ACT
relating to public insurance adjusters' unauthorized removal of
vehicles from vehicle storage facilities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter D, Chapter 4102, Insurance Code, is
amended by adding Section 4102.164 to read as follows:
Sec. 4102.164. UNAUTHORIZED VEHICLE REMOVAL PROHIBITED. A
license holder may not, without the knowledge and written consent
of the insured:
(1) execute a document related to the removal or
inspection of a motor vehicle at a vehicle storage facility
licensed under Chapter 2303, Occupations Code; or
(2) remove a motor vehicle at such a vehicle storage
facility.
SECTION 2. Section 4102.164, Insurance Code, as added by
this Act, applies only to conduct that occurs on or after the
effective date of this Act.
SECTION 3. This Act takes effect September 1, 2013.
