88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 222, Transportation Code,
1010 is amended by adding Section 222.036 to read as follows:
1111 Sec. 222.036. FEDERAL-AID HIGHWAY PROGRAM OPT-OUT. (a) To
1212 the extent permitted by federal law, the governor shall waive the
1313 state's right to receive money allocated under the federal-aid
1414 highway program and instead elect to receive the portion of the
1515 taxes appropriated to the Highway Trust Fund under Section 9503,
1616 Internal Revenue Code of 1986, that is attributable to highway
1717 users in the state, as calculated by the federal law permitting the
1818 waiver and election.
1919 (b) A waiver made under Subsection (a) must comply with all
2020 applicable federal requirements associated with the waiver.
2121 SECTION 2. (a) The comptroller shall conduct a study of
2222 how the state might benefit from withdrawing from the federal-aid
2323 highway program. The study conducted under this section must
2424 identify and analyze:
2525 (1) methods by which the state can withdraw from the
2626 federal-aid highway program, including methods that are not
2727 dependent on approval of the federal government; and
2828 (2) the costs and benefits associated with each
2929 method.
3030 (b) Not later than January 1, 2015, the comptroller shall
3131 submit to the legislature and the presiding officers of the
3232 standing committees of the senate and the house of representatives
3333 that have jurisdiction over issues related to transportation a
3434 report containing a summary of the study conducted under Subsection
3535 (a) of this section.
3636 SECTION 3. This Act takes effect September 1, 2013.
