8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subchapter B, Chapter 222, Transportation Code, |
---|
10 | 10 | | is amended by adding Section 222.036 to read as follows: |
---|
11 | 11 | | Sec. 222.036. FEDERAL-AID HIGHWAY PROGRAM OPT-OUT. (a) To |
---|
12 | 12 | | the extent permitted by federal law, the governor shall waive the |
---|
13 | 13 | | state's right to receive money allocated under the federal-aid |
---|
14 | 14 | | highway program and instead elect to receive the portion of the |
---|
15 | 15 | | taxes appropriated to the Highway Trust Fund under Section 9503, |
---|
16 | 16 | | Internal Revenue Code of 1986, that is attributable to highway |
---|
17 | 17 | | users in the state, as calculated by the federal law permitting the |
---|
18 | 18 | | waiver and election. |
---|
19 | 19 | | (b) A waiver made under Subsection (a) must comply with all |
---|
20 | 20 | | applicable federal requirements associated with the waiver. |
---|
21 | 21 | | SECTION 2. (a) The comptroller shall conduct a study of |
---|
22 | 22 | | how the state might benefit from withdrawing from the federal-aid |
---|
23 | 23 | | highway program. The study conducted under this section must |
---|
24 | 24 | | identify and analyze: |
---|
25 | 25 | | (1) methods by which the state can withdraw from the |
---|
26 | 26 | | federal-aid highway program, including methods that are not |
---|
27 | 27 | | dependent on approval of the federal government; and |
---|
28 | 28 | | (2) the costs and benefits associated with each |
---|
29 | 29 | | method. |
---|
30 | 30 | | (b) Not later than January 1, 2015, the comptroller shall |
---|
31 | 31 | | submit to the legislature and the presiding officers of the |
---|
32 | 32 | | standing committees of the senate and the house of representatives |
---|
33 | 33 | | that have jurisdiction over issues related to transportation a |
---|
34 | 34 | | report containing a summary of the study conducted under Subsection |
---|
35 | 35 | | (a) of this section. |
---|
36 | 36 | | SECTION 3. This Act takes effect September 1, 2013. |
