| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter E, Chapter 54, Education Code, is |
|---|
| 13 | 13 | | amended by adding Section 54.53975 to read as follows: |
|---|
| 14 | 14 | | Sec. 54.53975. INTERCOLLEGIATE ATHLETICS FEES; TEXAS A&M |
|---|
| 15 | 15 | | UNIVERSITY--TEXARKANA. (a) The board of regents of The Texas A&M |
|---|
| 16 | 16 | | University System may impose on each student enrolled at Texas A&M |
|---|
| 17 | 17 | | University--Texarkana an intercollegiate athletics fee in an |
|---|
| 18 | 18 | | amount not to exceed $9 per semester credit hour for each regular |
|---|
| 19 | 19 | | semester or summer session unless the amount of the fee is increased |
|---|
| 20 | 20 | | as provided by Subsection (c). |
|---|
| 21 | 21 | | (b) The fee may not be imposed unless approved by a majority |
|---|
| 22 | 22 | | vote of the students of the university who participate in a general |
|---|
| 23 | 23 | | student election held for that purpose. |
|---|
| 24 | 24 | | (c) The amount of the fee per semester credit hour may be |
|---|
| 25 | 25 | | increased from one academic year to the next only if approved by a |
|---|
| 26 | 26 | | majority vote of the students participating in a general student |
|---|
| 27 | 27 | | election held for that purpose or, if the amount of the increase |
|---|
| 28 | 28 | | does not exceed five percent, by a majority vote of the legislative |
|---|
| 29 | 29 | | body of the student government of the university. |
|---|
| 30 | 30 | | (d) A student enrolled in more than 12 semester credit hours |
|---|
| 31 | 31 | | shall pay the fee in an amount equal to the amount imposed on a |
|---|
| 32 | 32 | | student enrolled in 12 semester credit hours during the same |
|---|
| 33 | 33 | | semester or session. |
|---|
| 34 | 34 | | (e) A fee imposed under this section may be used to develop |
|---|
| 35 | 35 | | and maintain an intercollegiate athletics program at the |
|---|
| 36 | 36 | | university. |
|---|
| 37 | 37 | | (f) A fee imposed under this section is in addition to any |
|---|
| 38 | 38 | | other fee authorized by law and may not be considered in determining |
|---|
| 39 | 39 | | the amount of student services fees that may be imposed under |
|---|
| 40 | 40 | | Section 54.503. |
|---|
| 41 | 41 | | (g) The fee may not be charged after the fifth academic year |
|---|
| 42 | 42 | | in which the fee is first charged unless, before the end of that |
|---|
| 43 | 43 | | academic year, the university has issued bonds payable in whole or |
|---|
| 44 | 44 | | in part from the fee, in which event the fee may not be charged after |
|---|
| 45 | 45 | | the academic year in which all such bonds, including refunding |
|---|
| 46 | 46 | | bonds for those bonds, have been fully paid. |
|---|
| 47 | 47 | | SECTION 2. This Act applies beginning with the 2013 fall |
|---|
| 48 | 48 | | semester. |
|---|
| 49 | 49 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 50 | 50 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 51 | 51 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 52 | 52 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 53 | 53 | | Act takes effect September 1, 2013. |
