10	10	AN ACT
11	11	relating to the slaughter of certain domestic or exotic fowl
12	12	infected with or exposed to disease and compensation of owners of
13	13	fowl infected with or exposed to disease.
14	14	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	15	SECTION 1. The heading to Section 161.0415, Agriculture
16	16	Code, is amended to read as follows:
17	17	Sec. 161.0415. DISPOSAL OF DISEASED OR EXPOSED LIVESTOCK OR
18	18	FOWL.
19	19	SECTION 2. Sections 161.0415(a) and (b), Agriculture Code,
20	20	are amended to read as follows:
21	21	(a) The commission by order may require the slaughter of
22	22	livestock, domestic fowl, or exotic fowl, under the direction of
23	23	the commission, or the sale of livestock, domestic fowl, or exotic
24	24	fowl for immediate slaughter at a public slaughtering establishment
25	25	maintaining federal or state inspection if the livestock, domestic
26	26	fowl, or exotic fowl is exposed to or infected with a disease other
27	27	than bluetongue or vesicular stomatitis that:
28	28	(1) is recognized by the United States Department of
29	29	Agriculture as a foreign animal disease;
30	30	(2) is the subject of a cooperative eradication
31	31	program with the United States Department of Agriculture;
32	32	(3) is named on "List A" of the Office International
33	33	Des Epizooties; or
34	34	(4) is the subject of a state of emergency, as declared
35	35	by the governor.
36	36	(b) The commission by order may require the slaughter and
37	37	disposal of livestock, domestic fowl, or exotic fowl exposed to or
38	38	infected with a disease not listed in Subsection (a) if the
39	39	commission determines that action to be necessary for the
40	40	protection of animal health in this state. The commission shall
41	41	immediately deliver a copy of an order issued under this subsection
42	42	to the appropriate legislative oversight committees.
43	43	SECTION 3. The heading to Section 161.058, Agriculture
44	44	Code, is amended to read as follows:
45	45	Sec. 161.058. COMPENSATION OF LIVESTOCK OR FOWL OWNER.
46	46	SECTION 4. Sections 161.058(a) and (c), Agriculture Code,
47	47	are amended to read as follows:
48	48	(a) The commission may pay an indemnity to the owner of
49	49	livestock, domestic fowl, or exotic fowl exposed to or infected
50	50	with a disease if the commission considers it necessary to
51	51	eradicate the disease and to dispose of the exposed or diseased
52	52	livestock, domestic fowl, or exotic fowl. The commission shall
53	53	provide the owner with information regarding available state or
54	54	federal indemnity funds.
55	55	(c) The commission may spend funds appropriated for the
56	56	purpose of this section only for direct payment to owners of exposed
57	57	or infected livestock, domestic fowl, or exotic fowl.
58	58	SECTION 5. This Act takes effect immediately if it receives
59	59	a vote of two-thirds of all the members elected to each house, as
60	60	provided by Section 39, Article III, Texas Constitution. If this
61	61	Act does not receive the vote necessary for immediate effect, this
62	62	Act takes effect September 1, 2013.
