| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter C, Chapter 101, Labor Code, is |
|---|
| 13 | 13 | | amended by adding Section 101.1035 to read as follows: |
|---|
| 14 | 14 | | Sec. 101.1035. EXCLUSIVE BARGAINING REPRESENTATIVE; METHOD |
|---|
| 15 | 15 | | OF ELECTION. (a) In this section, "exclusive bargaining |
|---|
| 16 | 16 | | representative" means a labor union selected as the representative |
|---|
| 17 | 17 | | of the employees in an appropriate collective bargaining unit to |
|---|
| 18 | 18 | | represent the employees in their employment relations with |
|---|
| 19 | 19 | | employers. |
|---|
| 20 | 20 | | (b) An exclusive bargaining representative must be elected |
|---|
| 21 | 21 | | by secret ballot and by majority vote of the employees in the |
|---|
| 22 | 22 | | appropriate collective bargaining unit. |
|---|
| 23 | 23 | | SECTION 2. This Act does not affect a collective bargaining |
|---|
| 24 | 24 | | agreement or a meet and confer agreement, as applicable, or an |
|---|
| 25 | 25 | | organization representing public sector employees under state law, |
|---|
| 26 | 26 | | including any of the following: |
|---|
| 27 | 27 | | (1) Subchapter B, C, or D, Chapter 142, Local |
|---|
| 28 | 28 | | Government Code; |
|---|
| 29 | 29 | | (2) Subchapter H, I, or J, Chapter 143, Local |
|---|
| 30 | 30 | | Government Code; |
|---|
| 31 | 31 | | (3) Chapter 146, Local Government Code; |
|---|
| 32 | 32 | | (4) Chapter 147, Local Government Code; |
|---|
| 33 | 33 | | (5) Chapter 174, Local Government Code; or |
|---|
| 34 | 34 | | (6) Subchapter P, Chapter 451, Transportation Code. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2013. |
