99 relating to the permitting of certain small commercial development
1010 and county park sewage collection, treatment, and disposal systems
1111 as on-site sewage disposal systems.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter D, Chapter 366, Health and Safety
1414 Code, is amended by adding Section 366.0513 to read as follows:
1515 Sec. 366.0513. SMALL COMMERCIAL DEVELOPMENT AND COUNTY PARK
1616 SYSTEMS. (a) A small commercial development sewage collection,
1717 treatment, and disposal system may be permitted as an on-site
1818 sewage disposal system under this chapter if the system:
1919 (1) is located on property jointly owned by the
2020 property owners served by the system, as described by the county
2121 deed records;
2222 (2) produces not more than 5,000 gallons a day on an
2323 annual average basis;
2424 (3) serves an area that does not exceed 15 acres;
2525 (4) is designed to serve two or more sewage-generating
2626 units on separate tracts of land;
2727 (5) collects sewage only from commercial or
2828 institutional facilities or business parks;
2929 (6) is located more than 2,000 feet from the nearest
3030 reservoir used for municipal water supply, unless the owner of the
3131 reservoir consents in writing;
3232 (7) is approved by the governing body of any
3333 municipality:
3434 (A) that provides wastewater utility service to
3535 the property where the system is located at the time of the request
3636 for the permit; and
3737 (B) in whose boundaries or extraterritorial
3838 jurisdiction the property is located;
3939 (8) includes an interceptor for any facility engaged
4040 in food service activities, if required by commission rule or local
4141 ordinance or code;
4242 (9) does not accept waste streams from industrial
4343 users subject to general pretreatment regulations under 40 C.F.R.
4444 Part 403; and
4545 (10) is professionally managed by an entity with the
4646 appropriate authorization required by the commission to manage the
4747 system.
4848 (b) A sewage collection, treatment, and disposal system
4949 that serves a county park may be permitted as an on-site sewage
5050 disposal system under this chapter if the system:
5151 (1) is located on property owned or operated by the
5252 county;
5353 (2) produces not more than 5,000 gallons a day on an
5454 annual average basis;
5555 (3) collects only sewage generated at the park; and
5656 (4) meets the requirements of Subsections
5757 (a)(6)-(10).
5858 SECTION 2. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2013.
