88 AN ACT
99 relating to the elimination of the licensing and registration
1010 requirements for ringside physicians and timekeepers for combative
1111 sports events.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 2052.002(20), Occupations Code, is
1414 amended to read as follows:
1515 (20) "Ringside physician" means an individual who has
1616 an unrestricted and unlimited license [licensed] to practice
1717 medicine in this state and who, by agreement, is assigned as the
1818 physician for a combative sports event [registered with the
1919 department].
2020 SECTION 2. Section 2052.052(b), Occupations Code, is
2121 amended to read as follows:
2222 (b) The commission may adopt rules:
2323 (1) governing boxing, kickboxing, martial arts, or
2424 mixed martial arts contests and exhibitions;
2525 (2) establishing reasonable qualifications for an
2626 applicant seeking a license or registration from the department
2727 under this chapter;
2828 (3) recognizing a sanction, medical suspension, or
2929 disqualification of a licensee or registrant by a combative sports
3030 authority in any state, provided that if licensure or registration
3131 is denied based on those actions, an applicant has an opportunity
3232 for a hearing as prescribed by rule;
3333 (4) establishing selection criteria and procedures
3434 for the assignment of individuals who agree to act as ringside
3535 physicians and timekeepers for combative sports events [practice
3636 requirements or specialty certifications that a person licensed to
3737 practice medicine in this state must meet to register as a ringside
3838 physician];
3939 (5) requiring a contestant to present with an
4040 application for licensure or license renewal documentation of
4141 recent blood test results that demonstrate whether the contestant
4242 is free from hepatitis B virus, hepatitis C virus, human
4343 immunodeficiency virus, and any other communicable disease
4444 designated by commission rule and providing that a contestant's
4545 failure to provide the required blood test results disqualifies the
4646 contestant;
4747 (6) providing that to participate in any event a
4848 contestant must be free of hepatitis B virus, hepatitis C virus,
4949 human immunodeficiency virus, and any other communicable disease
5050 designated by rule;
5151 (7) requiring that a contestant present with an
5252 application for licensure or license renewal documentation of the
5353 results of a physical examination, including an ophthalmologic
5454 examination, and providing for disqualification of a contestant who
5555 is determined by an examining physician to be unfit;
5656 (8) establishing additional responsibilities for
5757 promoters; and
5858 (9) governing regulated amateur events.
5959 SECTION 3. Section 2052.107, Occupations Code, is amended
6060 to read as follows:
6161 Sec. 2052.107. OTHER COMBATIVE SPORTS LICENSES. Unless a
6262 person holds a license or registration issued under this chapter,
6363 the person may not act as a combative sports:
6464 (1) professional contestant;
6565 (2) manager of a professional contestant;
6666 (3) referee;
6767 (4) judge;
6868 (5) second;
6969 (6) [timekeeper;
7070 [(7)] matchmaker;
7171 [(8) ringside physician;] or
7272 (7) [(9)] event coordinator.
7373 SECTION 4. (a) A disciplinary or administrative proceeding
7474 pending under Chapter 51 or 2052, Occupations Code, that is related
7575 to a violation of licensing or registration requirements for a
7676 timekeeper or ringside physician under Chapter 2052, Occupations
7777 Code, as that chapter existed immediately before the effective date
7878 of this Act, is dismissed.
7979 (b) An administrative penalty assessed by the Texas
8080 Commission of Licensing and Regulation or the executive director of
8181 the Texas Department of Licensing and Regulation under Chapter
8282 2052, Occupations Code, related to a violation of Chapter 2052,
8383 Occupations Code, as that chapter existed immediately before the
8484 effective date of this Act, may be collected as provided by Chapter
8585 51, Occupations Code.
8686 (c) The change in law made by this Act does not affect the
8787 pending prosecution of an offense under Chapter 2052, Occupations
8888 Code, as that chapter existed immediately before the effective date
8989 of this Act. An offense committed before the effective date of this
9090 Act is governed by the law in effect at the time the offense was
9191 committed, and the former law is continued in effect for that
9292 purpose. For purposes of this subsection, an offense was committed
9393 before the effective date of this Act if any element of the offense
9494 occurred before that date.
9595 (d) As soon as practicable after the effective date of this
9696 Act, the Texas Department of Licensing and Regulation shall return
9797 a prorated portion of the fee paid to the department for the
9898 issuance or renewal of the registration or license to a person who
9999 holds a valid registration as a ringside physician or timekeeper
100100 issued under Chapter 2052, Occupations Code, as that chapter
101101 existed immediately before the effective date of this Act.
102102 SECTION 5. This Act takes effect September 1, 2013.
