99 AN ACT
1010 relating to excluding certain short-term employment from
1111 unemployment compensation chargebacks and grounds for benefit
1212 disqualification.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 204.022, Labor Code, is amended by
1515 adding Subsection (a-1) to read as follows:
1616 (a-1) Benefits computed on benefit wage credits of an
1717 employee or former employee may not be charged to the account of an
1818 employer if:
1919 (1) the employment did not constitute suitable work
2020 for the employee, as determined under Section 207.008; and
2121 (2) the employee worked for the employer for less than
2222 four weeks.
2323 SECTION 2. Section 207.045, Labor Code, is amended by
2424 adding Subsection (g-1) to read as follows:
2525 (g-1) An individual who voluntarily leaves the individual's
2626 last work is not disqualified for benefits under this section if:
2727 (1) at the time the last work began, the individual was
2828 receiving benefits under this subtitle;
2929 (2) the work did not constitute suitable work for the
3030 individual, as determined under Section 207.008; and
3131 (3) the individual was employed at the last work for
3232 less than four weeks.
3333 SECTION 3. The changes in law made by this Act apply only to
3434 a claim for unemployment compensation benefits filed with the Texas
3535 Workforce Commission on or after the effective date of this Act. A
3636 claim filed before the effective date of this Act is governed by the
3737 law in effect on the date the claim was filed, and the former law is
3838 continued in effect for that purpose.
3939 SECTION 4. This Act takes effect September 1, 2013.
