99 relating to an exemption from certain municipal and county solid
1010 waste disposal service requirements.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 364.034(h), Health and Safety Code, is
1313 amended to read as follows:
1414 (h) This section does not apply to a private entity that
1515 contracts to provide temporary solid waste disposal services to a
1616 construction project unless the project is located in a
1717 municipality that:
1818 (1) has a population of less than 10,000;
1919 (2) according to the most recent federal decennial
2020 census, had population growth of more than 20 percent during the
2121 decade preceding the most recent federal decennial census; and
2222 (3) is located in a county that has a population of
2323 more than 1.5 million in which more than 75 percent of the
2424 population lives in a single municipality.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2013.
