11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 364.034(h), Health and Safety Code, is | |
13 | 13 | amended to read as follows: | |
14 | 14 | (h) This section does not apply to a private entity that | |
15 | 15 | contracts to provide temporary solid waste disposal services to a | |
16 | 16 | construction project unless the project is located in a | |
17 | 17 | municipality that: | |
18 | 18 | (1) has a population of less than 10,000; | |
19 | 19 | (2) according to the most recent federal decennial | |
20 | 20 | census, had population growth of more than 20 percent during the | |
21 | 21 | decade preceding the most recent federal decennial census; and | |
22 | 22 | (3) is located in a county that has a population of | |
23 | 23 | more than 1.5 million in which more than 75 percent of the | |
24 | 24 | population lives in a single municipality. | |
25 | 25 | SECTION 2. This Act takes effect immediately if it receives | |
26 | 26 | a vote of two-thirds of all the members elected to each house, as | |
27 | 27 | provided by Section 39, Article III, Texas Constitution. If this | |
28 | 28 | Act does not receive the vote necessary for immediate effect, this | |
29 | 29 | Act takes effect September 1, 2013. |
