55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the alcoholic beverage licenses and permits that may be
88 issued in an area that has approved the sale of mixed beverages.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 25, Alcoholic Beverage Code, is amended
1111 by adding Section 25.14 to read as follows:
1212 Sec. 25.14. ISSUANCE OF PERMIT AUTHORIZED FOR CERTAIN
1313 AREAS. Notwithstanding any other provision of this code, a permit
1414 under this chapter may be issued for a premises in an area in which
1515 the voters have approved each of the following alcoholic beverage
1616 ballot issues in a local option election:
1717 (1) "The legal sale of beer and wine for off-premise
1818 consumption only."; and
1919 (2) "The legal sale of mixed beverages."
2020 SECTION 2. Chapter 69, Alcoholic Beverage Code, is amended
2121 by adding Section 69.17 to read as follows:
2222 Sec. 69.17. ISSUANCE OF LICENSE AUTHORIZED FOR CERTAIN
2323 AREAS. Notwithstanding any other provision of this code, a license
2424 under this chapter may be issued for a premises in an area in which
2525 the voters have approved each of the following alcoholic beverage
2626 ballot issues in a local option election:
2727 (1) "The legal sale of beer and wine for off-premise
2828 consumption only."; and
2929 (2) "The legal sale of mixed beverages."
3030 SECTION 3. Chapter 70, Alcoholic Beverage Code, is amended
3131 by adding Section 70.04 to read as follows:
3232 Sec. 70.04. ISSUANCE OF LICENSE AUTHORIZED FOR CERTAIN
3333 AREAS. Notwithstanding any other provision of this code, a license
3434 under this chapter may be issued for a premises in an area in which
3535 the voters have approved each of the following alcoholic beverage
3636 ballot issues in a local option election:
3737 (1) "The legal sale of beer and wine for off-premise
3838 consumption only."; and
3939 (2) "The legal sale of mixed beverages."
4040 SECTION 4. The changes in law made by this Act apply to a
4141 permit or license issued on or after the effective date of this Act
4242 regardless of when the local option election approving the sale of
4343 mixed beverages was held.
4444 SECTION 5. This Act takes effect September 1, 2013.
