| 7 | 7 | | relating to the alcoholic beverage licenses and permits that may be |

| 8 | 8 | | issued in an area that has approved the sale of mixed beverages. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 25, Alcoholic Beverage Code, is amended |
|---|
| 11 | 11 | | by adding Section 25.14 to read as follows: |
|---|
| 12 | 12 | | Sec. 25.14. ISSUANCE OF PERMIT AUTHORIZED FOR CERTAIN |
|---|
| 13 | 13 | | AREAS. Notwithstanding any other provision of this code, a permit |
|---|
| 14 | 14 | | under this chapter may be issued for a premises in an area in which |
|---|
| 15 | 15 | | the voters have approved each of the following alcoholic beverage |
|---|
| 16 | 16 | | ballot issues in a local option election: |
|---|
| 17 | 17 | | (1) "The legal sale of beer and wine for off-premise |
|---|
| 18 | 18 | | consumption only."; and |
|---|
| 19 | 19 | | (2) "The legal sale of mixed beverages." |
|---|
| 20 | 20 | | SECTION 2. Chapter 69, Alcoholic Beverage Code, is amended |
|---|
| 21 | 21 | | by adding Section 69.17 to read as follows: |
|---|
| 22 | 22 | | Sec. 69.17. ISSUANCE OF LICENSE AUTHORIZED FOR CERTAIN |
|---|
| 23 | 23 | | AREAS. Notwithstanding any other provision of this code, a license |
|---|
| 24 | 24 | | under this chapter may be issued for a premises in an area in which |
|---|
| 25 | 25 | | the voters have approved each of the following alcoholic beverage |
|---|

| 33 | 33 | | AREAS. Notwithstanding any other provision of this code, a license |

| 34 | 34 | | under this chapter may be issued for a premises in an area in which |
|---|
| 35 | 35 | | the voters have approved each of the following alcoholic beverage |
|---|
| 36 | 36 | | ballot issues in a local option election: |
|---|
| 37 | 37 | | (1) "The legal sale of beer and wine for off-premise |
|---|

| 40 | 40 | | SECTION 4. The changes in law made by this Act apply to a |
|---|
| 41 | 41 | | permit or license issued on or after the effective date of this Act |
|---|
| 42 | 42 | | regardless of when the local option election approving the sale of |
|---|
| 43 | 43 | | mixed beverages was held. |
|---|
| 44 | 44 | | SECTION 5. This Act takes effect September 1, 2013. |
