| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter A, Chapter 42, Human Resources Code, |

| 14 | 14 | | is amended by adding Section 42.004 to read as follows: |

| 15 | 15 | | Sec. 42.004. CONFIDENTIALITY OF INVESTIGATION INFORMATION. |

| 16 | 16 | | A photograph, videotape, audiotape, or other audio or visual |

| 17 | 17 | | recording, depiction, or documentation of a child that is made by |
|---|
| 18 | 18 | | the department in the course of an inspection or investigation |
|---|
| 19 | 19 | | authorized by this chapter or Section 261.401, Family Code, is |

| 20 | 20 | | confidential, is not subject to release under Chapter 552, |
|---|
| 21 | 21 | | Government Code, and may be released only as required by state or |
|---|
| 22 | 22 | | federal law or rules adopted by the executive commissioner. |
