9	9	relating to a cost-of-living increase in compensation for district
10	10	judges.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. The heading to Subchapter A, Chapter 32,
13	13	Government Code, is amended to read as follows:
14	14	SUBCHAPTER A. ADDITIONAL COMPENSATION PAID BY COUNTY
15	15	[FOR EXTRAJUDICIAL SERVICES]
16	16	SECTION 2. Subchapter A, Chapter 32, Government Code, is
17	17	amended by adding Section 32.002 to read as follows:
18	18	Sec. 32.002. COST-OF-LIVING INCREASE. (a) If the state has
19	19	not increased the state salary paid to a district judge during the
20	20	preceding three-year period, the commissioners court of a county
21	21	may pay each judge of a district court having jurisdiction in the
22	22	county an annual cost-of-living increase in an amount not to exceed
23	23	10 percent of the judge's combined salary from state and county
24	24	sources. Notwithstanding any other law, compensation paid to a
25	25	judge under this section is not included as part of the judge's
26	26	combined salary from state and county sources for purposes of the
27	27	salary limitations provided by Section 659.012.
28	28	(b) If, after a commissioners court of a county begins
29	29	paying a cost-of-living increase under this section, the state
30	30	increases the state salary paid to a district judge by an amount
31	31	equal to or greater than the cost-of-living increase paid by the
32	32	county, the commissioners court of the county shall stop paying the
33	33	cost-of-living increase.
34	34	SECTION 3. This Act takes effect January 1, 2014.
