1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Subchapter A, Chapter 32,
1313 Government Code, is amended to read as follows:
1414 SUBCHAPTER A. ADDITIONAL COMPENSATION PAID BY COUNTY
1515 [FOR EXTRAJUDICIAL SERVICES]
1616 SECTION 2. Subchapter A, Chapter 32, Government Code, is
1717 amended by adding Section 32.002 to read as follows:
1818 Sec. 32.002. COST-OF-LIVING INCREASE. (a) If the state has
1919 not increased the state salary paid to a district judge during the
2020 preceding three-year period, the commissioners court of a county
2121 may pay each judge of a district court having jurisdiction in the
2222 county an annual cost-of-living increase in an amount not to exceed
2323 10 percent of the judge's combined salary from state and county
2424 sources. Notwithstanding any other law, compensation paid to a
2525 judge under this section is not included as part of the judge's
2626 combined salary from state and county sources for purposes of the
2727 salary limitations provided by Section 659.012.
2828 (b) If, after a commissioners court of a county begins
2929 paying a cost-of-living increase under this section, the state
3030 increases the state salary paid to a district judge by an amount
3131 equal to or greater than the cost-of-living increase paid by the
3232 county, the commissioners court of the county shall stop paying the
3333 cost-of-living increase.
3434 SECTION 3. This Act takes effect January 1, 2014.
