| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Chapter 604, Business & Commerce Code, is | |
| 11 | 11 | amended by adding Subchapter D to read as follows: | |
| 12 | 12 | SUBCHAPTER D. REDEMPTION OF CERTAIN LOW-VALUE CARDS | |
| 13 | 13 | Sec. 604.151. APPLICABILITY OF SUBCHAPTER. (a) This | |
| 14 | 14 | subchapter does not apply to a stored value card: | |
| 15 | 15 | (1) described by Sections 604.002(1)-(3); | |
| 16 | 16 | (2) issued as a refund for merchandise returned | |
| 17 | 17 | without a receipt; or | |
| 18 | 18 | (3) that has an initial value of $5 or less and to | |
| 19 | 19 | which additional value cannot be added. | |
| 20 | 20 | (b) Except as otherwise provided by Subsection (a), Section | |
| 21 | 21 | 604.002 does not apply to this subchapter. | |
| 22 | 22 | Sec. 604.152. CASH REFUND FOR LOW-VALUE CARD. If a stored | |
| 23 | 23 | value card is redeemed in person to make a purchase and a balance of | |
| 24 | 24 | less than $5 remains following the redemption, at the consumer's | |
| 25 | 25 | request the seller shall refund the balance of the card in cash to | |
| 26 | 26 | the consumer. | |
| 27 | 27 | SECTION 2. This Act takes effect September 1, 2013. |
