99 relating to authorizing local governments to participate in
1010 statewide technology centers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 2054.375, Government Code, is amended to
1313 read as follows:
1414 Sec. 2054.375. DEFINITIONS [DEFINITION]. In this
1515 subchapter:
1616 (1) "Governmental entity" means a state agency or
1717 local government.
1818 (2) "Statewide[, "statewide] technology center" means
1919 a statewide technology center established or operated under this
2020 subchapter.
2121 SECTION 2. Section 2054.376(a), Government Code, is amended
2222 to read as follows:
2323 (a) This subchapter applies to all information resources
2424 technologies, other than telecommunications service [services],
2525 advanced communications services, or information service, as those
2626 terms are defined by 47 U.S.C. Section 153, that are:
2727 (1) obtained by a state agency using state money; [or]
2828 (2) used by a state agency; or
2929 (3) used by a participating local government.
3030 SECTION 3. Subchapter L, Chapter 2054, Government Code, is
3131 amended by adding Section 2054.3771 to read as follows:
3232 Sec. 2054.3771. LOCAL GOVERNMENTS. The department may
3333 establish or expand a statewide technology center to include
3434 participation by a local government. The executive director and
3535 the department have all the powers necessary or appropriate,
3636 consistent with this chapter, to accomplish that purpose.
3737 SECTION 4. Section 2054.378(a), Government Code, is amended
3838 to read as follows:
3939 (a) The department may operate statewide technology centers
4040 to provide two or more governmental entities [state agencies], on a
4141 cost-sharing basis, services relating to:
4242 (1) information resources and information resources
4343 technology; and
4444 (2) the deployment, [and] development, and
4545 maintenance of software [statewide] applications.
4646 SECTION 5. Section 2054.380(a), Government Code, is amended
4747 to read as follows:
4848 (a) The department shall set and charge a fee to each
4949 governmental entity [state agency] that receives a service from a
5050 statewide technology center in an amount sufficient to cover the
5151 direct and indirect cost of providing the service.
5252 SECTION 6. Subchapter L, Chapter 2054, Government Code, is
5353 amended by adding Section 2054.3851 to read as follows:
5454 Sec. 2054.3851. LOCAL GOVERNMENT PARTICIPATION AND
5555 SELECTION. (a) A local government may submit a request to the
5656 department to receive services or operations through a statewide
5757 technology center. The local government shall identify its
5858 particular requirements, operations costs, and requested service
5959 levels.
6060 (b) On receipt of the request, the department shall conduct
6161 a cost and requirements analysis for the local government.
6262 (c) If the department selects the local government for
6363 participation in a statewide technology center, the department
6464 shall provide notice to the local government that includes:
6565 (1) the scope of the services to be provided to the
6666 local government;
6767 (2) a schedule of anticipated costs for the local
6868 government; and
6969 (3) the implementation schedule for the local
7070 government.
7171 (d) If selected to participate in a statewide technology
7272 center, a local government may contract with the department to
7373 receive the identified services and have the identified operations
7474 performed through the statewide technology center.
7575 (e) Two or more local governments that are parties to an
7676 interlocal agreement, acting through the entity designated by the
7777 parties to supervise performance of the interlocal agreement under
7878 Section 791.013, may apply to the department and participate in a
7979 statewide technology center.
8080 SECTION 7. Section 2054.387, Government Code, is amended to
8181 read as follows:
8282 Sec. 2054.387. INTERAGENCY CONTRACT; COMPLIANCE WITH
8383 SERVICE LEVELS. The department shall ensure compliance with
8484 service levels agreed to in an interagency contract or
8585 intergovernmental contract, as appropriate, executed under this
8686 subchapter.
8787 SECTION 8. This Act takes effect immediately if it receives
8888 a vote of two-thirds of all the members elected to each house, as
8989 provided by Section 39, Article III, Texas Constitution. If this
9090 Act does not receive the vote necessary for immediate effect, this
9191 Act takes effect September 1, 2013.
