99 relating to certain exclusions for personal automobile liability
1010 insurance.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 1952, Insurance Code, is amended by
1313 adding Subchapter H to read as follows:
1414 SUBCHAPTER H. PERMISSIVE DRIVER AND SPECIFICALLY NAMED DRIVER
1515 EXCLUSIONS
1616 Sec. 1952.351. DEFINITIONS. In this subchapter:
1717 (1) "Permissive driver exclusion" means a provision or
1818 endorsement of a personal automobile liability insurance policy
1919 that excludes drivers who do not reside in the insured's household
2020 and who receive permission from the insured to drive the insured's
2121 vehicle from coverage under the policy. The term does not include a
2222 provision or endorsement of a personal automobile liability
2323 insurance policy that excludes from coverage:
2424 (A) specific named persons; or
2525 (B) family members and residents of the insured's
2626 household who are not listed as authorized drivers in a provision or
2727 endorsement of the policy.
2828 (2) "Specifically named driver exclusion" means a
2929 provision or endorsement of a personal automobile liability
3030 insurance policy that excludes specific named persons from coverage
3131 under the policy.
3232 Sec. 1952.352. APPLICABILITY. This subchapter applies to
3333 an insurer writing personal automobile liability insurance in this
3434 state, including an insurance company, corporation, reciprocal or
3535 interinsurance exchange, mutual insurance company, capital stock
3636 company, association, county mutual insurance company, Lloyd's
3737 plan, and other insurer.
3838 Sec. 1952.353. PERMISSIVE DRIVER EXCLUSIONS PROHIBITED. An
3939 insurer may not use a permissive driver exclusion for a personal
4040 automobile liability insurance policy delivered, issued for
4141 delivery, or renewed in this state.
4242 Sec. 1952.354. REQUIRED DISCLOSURE REGARDING SPECIFICALLY
4343 NAMED DRIVER EXCLUSIONS. (a) Before accepting any premium or fee
4444 for a policy with a specifically named driver exclusion, an agent or
4545 insurer must make the following written disclosure to the applicant
4646 or insured:
4747 WARNING: THIS POLICY DOES NOT PROVIDE COVERAGE FOR
4848 INDIVIDUALS SPECIFICALLY NAMED AS EXCLUDED FROM
4949 COVERAGE.
5050 (b) An agent or insurer that delivers or issues for delivery
5151 a policy in this state with a specifically named driver exclusion
5252 shall specifically include in the policy and conspicuously identify
5353 on the front of any proof of insurance document issued to the
5454 insured the required disclosure under Subsection (a).
5555 SECTION 2. Section 912.152(a), Insurance Code, is amended
5656 to read as follows:
5757 (a) A county mutual insurance company is subject to:
5858 (1) Sections 1952.051-1952.055;
5959 (2) Subchapter H, Chapter 1952;
6060 (3) Subchapter B, Chapter 2002;
6161 (4) [(3)] Chapter 2301; and
6262 (5) [(4)] Articles 5.06 and 5.35.
6363 SECTION 3. Section 1952.001, Insurance Code, is amended to
6464 read as follows:
6565 Sec. 1952.001. APPLICABILITY OF CHAPTER. Except as
6666 provided by Sections [Section] 1952.201 and 1952.352, this chapter
6767 applies to an insurer writing automobile insurance in this state,
6868 including an insurance company, corporation, reciprocal or
6969 interinsurance exchange, mutual insurance company, association,
7070 Lloyd's plan, or other insurer.
7171 SECTION 4. Section 601.081, Transportation Code, is amended
7272 to read as follows:
7373 Sec. 601.081. STANDARD PROOF OF MOTOR VEHICLE LIABILITY
7474 INSURANCE FORM. (a) In this section, "specifically named driver
7575 exclusion" has the meaning assigned by Section 1952.351, Insurance
7676 Code.
7777 (b) A standard proof of motor vehicle liability insurance
7878 form prescribed by the Texas Department of Insurance must include:
7979 (1) the name of the insurer;
8080 (2) the insurance policy number;
8181 (3) the policy period;
8282 (4) the name and address of each insured;
8383 (5) the policy limits or a statement that the coverage
8484 of the policy complies with the minimum amounts of motor vehicle
8585 liability insurance required by this chapter; [and]
8686 (6) the make and model of each covered vehicle; and
8787 (7) for a policy with a specifically named driver
8888 exclusion, the required disclosure under Section 1952.354,
8989 Insurance Code.
9090 SECTION 5. The changes in law made by this Act apply only to
9191 a personal automobile liability insurance policy that is delivered,
9292 issued for delivery, or renewed on or after January 1, 2014. A
9393 policy delivered, issued for delivery, or renewed before January 1,
9494 2014, is governed by the law as it existed immediately before the
9595 effective date of this Act, and that law is continued in effect for
9696 that purpose.
9797 SECTION 6. This Act takes effect September 1, 2013.
