| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Sections 51.803(a-3) and (k), Education Code, |
|---|
| 14 | 14 | | are amended to read as follows: |
|---|
| 15 | 15 | | (a-3) Notwithstanding Subsection (a-1), The University of |
|---|
| 16 | 16 | | Texas at Austin may not offer admission under that subsection for an |
|---|
| 17 | 17 | | academic year after the 2017-2018 [2015-2016] academic year. |
|---|
| 18 | 18 | | (k) A general academic teaching institution may not offer |
|---|
| 19 | 19 | | admission under Subsection (a-1) for an academic year after the |
|---|
| 20 | 20 | | 2017-2018 academic year if, on the date of the institution's |
|---|
| 21 | 21 | | general deadline for applications for admission of first-time |
|---|
| 22 | 22 | | undergraduate students for that academic year: |
|---|
| 23 | 23 | | (1) a final court order applicable to the institution |
|---|
| 24 | 24 | | prohibits the institution from considering an applicant's race or |
|---|
| 25 | 25 | | ethnicity as a factor in the institution's decisions relating to |
|---|
| 26 | 26 | | first-time undergraduate admissions; or |
|---|
| 27 | 27 | | (2) the institution's governing board by rule, policy, |
|---|
| 28 | 28 | | or other manner has provided that an applicant's race or ethnicity |
|---|
| 29 | 29 | | may not be considered as a factor in the institution's decisions |
|---|
| 30 | 30 | | relating to first-time undergraduate admissions for that[, except |
|---|
| 31 | 31 | | that this subdivision does not apply to an institution that did not |
|---|
| 32 | 32 | | consider, on or before June 1, 2009, an applicant's race or |
|---|
| 33 | 33 | | ethnicity as a factor in its admissions of first-time resident |
|---|
| 34 | 34 | | undergraduate students for the 2009-2010] academic year. |

| 35 | 35 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2013. |
