99 AN ACT
1010 relating to limitations on the automatic admission of undergraduate
1111 students to general academic teaching institutions.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Sections 51.803(a-3) and (k), Education Code,
1414 are amended to read as follows:
1515 (a-3) Notwithstanding Subsection (a-1), The University of
1616 Texas at Austin may not offer admission under that subsection for an
1717 academic year after the 2017-2018 [2015-2016] academic year.
1818 (k) A general academic teaching institution may not offer
1919 admission under Subsection (a-1) for an academic year after the
2020 2017-2018 academic year if, on the date of the institution's
2121 general deadline for applications for admission of first-time
2222 undergraduate students for that academic year:
2323 (1) a final court order applicable to the institution
2424 prohibits the institution from considering an applicant's race or
2525 ethnicity as a factor in the institution's decisions relating to
2626 first-time undergraduate admissions; or
2727 (2) the institution's governing board by rule, policy,
2828 or other manner has provided that an applicant's race or ethnicity
2929 may not be considered as a factor in the institution's decisions
3030 relating to first-time undergraduate admissions for that[, except
3131 that this subdivision does not apply to an institution that did not
3232 consider, on or before June 1, 2009, an applicant's race or
3333 ethnicity as a factor in its admissions of first-time resident
3434 undergraduate students for the 2009-2010] academic year.
3535 SECTION 2. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2013.
