99 relating to certain conditions of, penalties for violating, and
1010 collection of information about protective orders issued in certain
1111 family violence, sexual assault or abuse, stalking, or trafficking
1212 cases.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. The heading to Chapter 7A, Code of Criminal
1515 Procedure, is amended to read as follows:
1616 CHAPTER 7A. PROTECTIVE ORDER FOR [CERTAIN] VICTIMS OF [TRAFFICKING
1717 OR] SEXUAL ASSAULT OR ABUSE, STALKING, OR TRAFFICKING
1818 SECTION 2. Article 7A.05(a), Code of Criminal Procedure, is
1919 amended to read as follows:
2020 (a) In a protective order issued under this chapter, the
2121 court may:
2222 (1) order the alleged offender to take action as
2323 specified by the court that the court determines is necessary or
2424 appropriate to prevent or reduce the likelihood of future harm to
2525 the applicant or a member of the applicant's family or household; or
2626 (2) prohibit the alleged offender from:
2727 (A) communicating:
2828 (i) directly or indirectly with the
2929 applicant or any member of the applicant's family or household in a
3030 threatening or harassing manner; or
3131 (ii) in any manner with the applicant or any
3232 member of the applicant's family or household except through the
3333 applicant's attorney or a person appointed by the court, if the
3434 court finds good cause for the prohibition;
3535 (B) going to or near the residence, place of
3636 employment or business, or child-care facility or school of the
3737 applicant or any member of the applicant's family or household;
3838 (C) engaging in conduct directed specifically
3939 toward the applicant or any member of the applicant's family or
4040 household, including following the person, that is reasonably
4141 likely to harass, annoy, alarm, abuse, torment, or embarrass the
4242 person; and
4343 (D) possessing a firearm, unless the alleged
4444 offender is a peace officer, as defined by Section 1.07, Penal Code,
4545 actively engaged in employment as a sworn, full-time paid employee
4646 of a state agency or political subdivision.
4747 SECTION 3. Sections 411.042(b) and (g), Government Code,
4848 are amended to read as follows:
4949 (b) The bureau of identification and records shall:
5050 (1) procure and file for record photographs, pictures,
5151 descriptions, fingerprints, measurements, and other pertinent
5252 information of all persons arrested for or charged with a criminal
5353 offense or convicted of a criminal offense, regardless of whether
5454 the conviction is probated;
5555 (2) collect information concerning the number and
5656 nature of offenses reported or known to have been committed in the
5757 state and the legal steps taken in connection with the offenses, and
5858 other information useful in the study of crime and the
5959 administration of justice, including information that enables the
6060 bureau to create a statistical breakdown of:
6161 (A) offenses in which family violence was
6262 involved;
6363 (B) offenses under Sections 22.011 and 22.021,
6464 Penal Code; and
6565 (C) offenses under Sections 20A.02 and 43.05,
6666 Penal Code;
6767 (3) make ballistic tests of bullets and firearms and
6868 chemical analyses of bloodstains, cloth, materials, and other
6969 substances for law enforcement officers of the state;
7070 (4) cooperate with identification and crime records
7171 bureaus in other states and the United States Department of
7272 Justice;
7373 (5) maintain a list of all previous background checks
7474 for applicants for any position regulated under Chapter 1702,
7575 Occupations Code, who have undergone a criminal history background
7676 check under Section 411.119, if the check indicates a Class B
7777 misdemeanor or equivalent offense or a greater offense;
7878 (6) collect information concerning the number and
7979 nature of protective orders and all other pertinent information
8080 about all persons on active protective orders, including pertinent
8181 information about persons subject to conditions of bond imposed for
8282 the protection of the victim in any family violence, sexual assault
8383 or abuse, or stalking case. Information in the law enforcement
8484 information system relating to an active protective order shall
8585 include:
8686 (A) the name, sex, race, date of birth, personal
8787 descriptors, address, and county of residence of the person to whom
8888 the order is directed;
8989 (B) any known identifying number of the person to
9090 whom the order is directed, including the person's social security
9191 number or driver's license number;
9292 (C) the name and county of residence of the
9393 person protected by the order;
9494 (D) the residence address and place of employment
9595 or business of the person protected by the order, unless that
9696 information is excluded from the order under Section 85.007, Family
9797 Code;
9898 (E) the child-care facility or school where a
9999 child protected by the order normally resides or which the child
100100 normally attends, unless that information is excluded from the
101101 order under Section 85.007, Family Code;
102102 (F) the relationship or former relationship
103103 between the person who is protected by the order and the person to
104104 whom the order is directed; [and]
105105 (G) the conditions of bond imposed on the person
106106 to whom the order is directed, if any, for the protection of a
107107 victim in any family violence, sexual assault or abuse, or stalking
108108 case; and
109109 (H) the date the order expires;
110110 (7) grant access to criminal history record
111111 information in the manner authorized under Subchapter F;
112112 (8) collect and disseminate information regarding
113113 offenders with mental impairments in compliance with Chapter 614,
114114 Health and Safety Code; and
115115 (9) record data and maintain a state database for a
116116 computerized criminal history record system and computerized
117117 juvenile justice information system that serves:
118118 (A) as the record creation point for criminal
119119 history record information and juvenile justice information
120120 maintained by the state; and
121121 (B) as the control terminal for the entry of
122122 records, in accordance with federal law and regulations, federal
123123 executive orders, and federal policy, into the federal database
124124 maintained by the Federal Bureau of Investigation.
125125 (g) The department may adopt reasonable rules under this
126126 section relating to:
127127 (1) law enforcement information systems maintained by
128128 the department;
129129 (2) the collection, maintenance, and correction of
130130 records;
131131 (3) reports of criminal history information submitted
132132 to the department;
133133 (4) active protective orders [issued under Title 4,
134134 Family Code,] and reporting procedures that ensure that information
135135 relating to the issuance and dismissal of an active protective
136136 order [and to the dismissal of an active protective order] is
137137 reported to the local law enforcement agency at the time of the
138138 order's issuance or dismissal and entered by the local law
139139 enforcement agency in the state's law enforcement information
140140 system;
141141 (5) the collection of information described by
142142 Subsection (h); [and]
143143 (6) a system for providing criminal history record
144144 information through the criminal history clearinghouse under
145145 Section 411.0845; and
146146 (7) active conditions of bond imposed on a defendant
147147 for the protection of a victim in any family violence, sexual
148148 assault or abuse, or stalking case, and reporting procedures that
149149 ensure that information relating to the issuance, modification, or
150150 removal of the conditions of bond is reported to the local law
151151 enforcement agency at the time of the issuance, modification, or
152152 removal and entered by the local law enforcement agency in the
153153 state's law enforcement information system.
154154 SECTION 4. The heading to Section 25.07, Penal Code, is
155155 amended to read as follows:
156156 Sec. 25.07. VIOLATION OF CERTAIN COURT ORDERS OR CONDITIONS
157157 OF BOND IN A FAMILY VIOLENCE, SEXUAL ASSAULT OR ABUSE, OR STALKING
158158 CASE.
159159 SECTION 5. Section 25.07(a), Penal Code, is amended to read
160160 as follows:
161161 (a) A person commits an offense if, in violation of a
162162 condition of bond set in a family violence, sexual assault or abuse,
163163 or stalking case and related to the safety of a [the] victim or the
164164 safety of the community, an order issued under Article 17.292, Code
165165 of Criminal Procedure, an order issued under Section 6.504, Family
166166 Code, Chapter 83, Family Code, if the temporary ex parte order has
167167 been served on the person, or Chapter 85, Family Code, or an order
168168 issued by another jurisdiction as provided by Chapter 88, Family
169169 Code, the person knowingly or intentionally:
170170 (1) commits family violence or an act in furtherance
171171 of an offense under Section 22.011, 22.021, or 42.072;
172172 (2) communicates:
173173 (A) directly with a protected individual or a
174174 member of the family or household in a threatening or harassing
175175 manner;
176176 (B) a threat through any person to a protected
177177 individual or a member of the family or household; or
178178 (C) in any manner with the protected individual
179179 or a member of the family or household except through the person's
180180 attorney or a person appointed by the court, if the violation is of
181181 an order described by this subsection and the order prohibits any
182182 communication with a protected individual or a member of the family
183183 or household;
184184 (3) goes to or near any of the following places as
185185 specifically described in the order or condition of bond:
186186 (A) the residence or place of employment or
187187 business of a protected individual or a member of the family or
188188 household; or
189189 (B) any child care facility, residence, or school
190190 where a child protected by the order or condition of bond normally
191191 resides or attends;
192192 (4) possesses a firearm; or
193193 (5) harms, threatens, or interferes with the care,
194194 custody, or control of a pet, companion animal, or assistance
195195 animal that is possessed by a person protected by the order.
196196 SECTION 6. Section 25.07(b), Penal Code, is amended by
197197 adding Subdivisions (4), (5), and (6) to read as follows:
198198 (4) "Sexual abuse" means any act as described by
199199 Section 21.02 or 21.11.
200200 (5) "Sexual assault" means any act as described by
201201 Section 22.011 or 22.021.
202202 (6) "Stalking" means any conduct that constitutes an
203203 offense under Section 42.072.
204204 SECTION 7. The heading to Section 38.112, Penal Code, is
205205 amended to read as follows:
206206 Sec. 38.112. VIOLATION OF PROTECTIVE ORDER ISSUED ON BASIS
207207 OF SEXUAL ASSAULT OR ABUSE, STALKING, OR TRAFFICKING.
208208 SECTION 8. Section 38.112(a), Penal Code, is amended to
209209 read as follows:
210210 (a) A person commits an offense if, in violation of an order
211211 issued under Chapter 7A, Code of Criminal Procedure, the person
212212 knowingly:
213213 (1) communicates:
214214 (A) directly or indirectly with the applicant or
215215 any member of the applicant's family or household in a threatening
216216 or harassing manner; or
217217 (B) in any manner with the applicant or any
218218 member of the applicant's family or household except through the
219219 applicant's attorney or a person appointed by the court;
220220 (2) goes to or near the residence, place of employment
221221 or business, or child-care facility or school of the applicant or
222222 any member of the applicant's family or household; or
223223 (3) possesses a firearm.
224224 SECTION 9. The changes in law made by this Act in amending
225225 Sections 25.07 and 38.112, Penal Code, apply only to an offense
226226 committed on or after the effective date of this Act. An offense
227227 committed before the effective date of this Act is governed by the
228228 law in effect on the date the offense was committed, and the former
229229 law is continued in effect for that purpose. For purposes of this
230230 subsection, an offense was committed before the effective date of
231231 this Act if any element of the offense occurred before that date.
232232 SECTION 10. This Act takes effect September 1, 2013.
