77 relating to the repeal of certain offenses relating to certain
88 occupations regulated by the Texas Department of Licensing and
99 Regulation.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 754.0141(f), Health and Safety Code, is
1212 amended to read as follows:
1313 (f) An inspection by a QEI-1 certified inspector of
1414 equipment in a single-family dwelling may be performed only at the
1515 request and with the consent of the owner. The owner of a
1616 single-family dwelling is not subject to Section 754.022 or[,]
1717 754.023[, or 754.024].
1818 SECTION 2. The heading to Subchapter E, Chapter 91, Labor
1919 Code, is amended to read as follows:
2020 SUBCHAPTER E. PROHIBITED ACTS; ENFORCEMENT [PENALTY]
2121 SECTION 3. Section 1151.253, Occupations Code, is
2222 transferred to Subchapter E, Chapter 1151, Occupations Code, and
2323 redesignated as Section 1151.206, Occupations Code, to read as
2424 follows:
2525 Sec. 1151.206 [1151.253]. COMPLAINT OF VIOLATION. A
2626 person may file a complaint with the department concerning a
2727 violation of this chapter or a rule adopted by the commission under
2828 this chapter.
2929 SECTION 4. The heading to Subchapter G, Chapter 2052,
3030 Occupations Code, is amended to read as follows:
3131 SUBCHAPTER G. DISCIPLINARY PROCEDURES; PENALTIES [CRIMINAL
3232 OFFENSE]
3333 SECTION 5. The following provisions are repealed:
3434 (1) Section 754.024, Health and Safety Code;
3535 (2) Section 91.063, Labor Code;
3636 (3) Subchapter D, Chapter 92, Labor Code;
3737 (4) the heading to Subchapter F, Chapter 1151,
3838 Occupations Code;
3939 (5) Sections 1151.251, 1151.252, 1152.252, and
4040 2052.309, Occupations Code;
4141 (6) Subchapter H, Chapter 1202, Occupations Code;
4242 (7) Subchapter N, Chapter 1601, Occupations Code; and
4343 (8) Subchapter L, Chapter 1602, Occupations Code.
4444 SECTION 6. The repeal of an offense by this Act does not
4545 apply to an offense committed before the effective date of the
4646 repeal. An offense committed before the effective date of the
4747 repeal is governed by the law as it existed on the date the offense
4848 was committed, and the former law is continued in effect for that
4949 purpose. For purposes of this section, an offense was committed
5050 before the effective date of the repeal if any element of the
5151 offense occurred before that date.
5252 SECTION 7. This Act takes effect immediately if it receives
5353 a vote of two-thirds of all the members elected to each house, as
5454 provided by Section 39, Article III, Texas Constitution. If this
5555 Act does not receive the vote necessary for immediate effect, this
5656 Act takes effect September 1, 2013.
