9	9	AN ACT
10	10	relating to the transfer of certain state property from the Texas
11	11	Juvenile Justice Department to Jefferson County.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. (a) Not later than January 31, 2014, the Texas
14	14	Juvenile Justice Department shall donate and transfer to Jefferson
15	15	County the real property described by Subsection (e) of this
16	16	section.
17	17	(b) Jefferson County may use the property transferred under
18	18	this Act only for a purpose that benefits the public interest of the
19	19	state. If Jefferson County uses the property for any purpose other
20	20	than a purpose described by this subsection, ownership of the
21	21	property automatically reverts to the Texas Juvenile Justice
22	22	Department.
23	23	(c) The Texas Juvenile Justice Department shall transfer
24	24	the property by an appropriate instrument of transfer. The
25	25	instrument of transfer must:
26	26	(1) provide that:
27	27	(A) Jefferson County may use the property only
28	28	for a purpose that benefits the public interest of the state; and
29	29	(B) ownership of the property will automatically
30	30	revert to the Texas Juvenile Justice Department if Jefferson County
31	31	uses the property for any purpose other than a purpose described by
32	32	Paragraph (A) of this subdivision; and
33	33	(2) describe the property to be transferred by metes
34	34	and bounds.
35	35	(d) The Texas Juvenile Justice Department shall retain
36	36	custody of the instrument of transfer after the instrument of
37	37	transfer is filed in the real property records of Jefferson County.
38	38	(e) The real property referred to in this section is
39	39	described as follows:
40	40	Field note description of a 50.234 acre tract of land in the
41	41	T. & N.O.R.R. Survey, Section No. 1, Abstract No. 257 and the W.M.
42	42	Carrol Survey, Abstract No. 13, Jefferson County, Texas. BEING a
43	43	50.234 acre tract or parcel of land out of and a part of tracts 15-A
44	44	and 14-A of the partition map no. 2 of the McFaddin Trust as
45	45	recorded in Vol. 7, Pg. 133, of the map records of Jefferson County,
46	46	said tract 15-A being conveyed to Jefferson County by that certain
47	47	deed from J.L. Caldwell Company Trust as recorded on film code no.
48	48	102-98-2140, tract no. 14-A from Divernon M. Berly to Jefferson
49	49	County as recorded on film code no. 102-98-2006, Jefferson County
50	50	deed records, said 50.234 acre tract being more fully described by
51	51	metes and bounds as follows:
52	52	For a locative corner, a Gulf States Utilities Company
53	53	concrete monument found at the intersection of the Southerly line
54	54	of said tract 15-A and the Westerly Right-of-Way line of U.S.
55	55	Highway 69,96 and 287 (338 feet wide). Said monument also being the
56	56	Southeast corner of a Gulf States Utilities Company fee strip (198
57	57	feet wide) as recorded in Vol. 1586, Pg. 196 of the Deed Records of
58	58	Jefferson County, Texas;
59	59	THENCE North 23 degrees 37' 09" West with the Westerly
60	60	Right-of-Way line of said Highway for a distance of 216.64' to a
61	61	1/2" iron rod found at the intersection of the Northerly line of
62	62	said fee strip and the Westerly Right-of-Way line of said Highway
63	63	and being the Southeast corner of that certain tract described in
64	64	deed from J.L. Caldwell Company Trust to Jefferson County and
65	65	recorded of film code no. 102-98-2140, Jefferson County Deed
66	66	Records;
67	67	THENCE North 23 degrees 57' 31" West along the Westerly
68	68	Right-of-Way line of said Highway and the Easterly line of tract
69	69	15-A for a distance of 1098.15' to a 1/2" iron rod set for the
70	70	Southeast corner of the herein described tract and THE PLACE OF
71	71	BEGINNING;
72	72	THENCE North 79 degrees 06' 40" West a distance of 1462.25' to
73	73	an iron rod set for the Southwest corner of the herein described
74	74	tract;
75	75	THENCE North 23 degrees 57' 31" West 1200' from and parallel
76	76	to the Westerly Right-of-Way line of U.S. Highway 69,96 and 287 for
77	77	a distance of 1825.0' to an iron rod set for the Northwest corner of
78	78	the herein described tract, said corner being located in the
79	79	Northerly line of the Jefferson County 250 acre tract and the
80	80	Southerly line of a 689.690 acre tract from Jefferson County to the
81	81	Texas Department of Criminal Justice and described in deed on film

83	83	THENCE South 79 degrees 06' 40" East along the Northerly line
84	84	of said Jefferson County 250 acre tract and the Southerly line of
85	85	the Texas Department of Criminal Justice 689.690 acre tract for a
86	86	distance of 1442.66' to a 3.25" aluminum disk set in the Southerly
87	87	Right-of-Way line of proposed F.M. 3514 as described in a donation
88	88	deed from Jefferson County to the Texas Department of
89	89	Transportation and recorded on film code no. 104-16-1046, Jefferson
90	90	County Deed Records;
91	91	THENCE South 27 degrees 54' 08" East along the proposed South
92	92	Right-of-Way line of F.M. 3514 a distance of 233.76' to a 3.25"
93	93	aluminum disk set in the existing Right-of-Way line of U.S. Highway
94	94	69.96 and 287;
95	95	THENCE South 23 degrees 57' 31" East along the Westerly
96	96	Right-of-Way line of said Highway and the Easterly line of the
97	97	herein described tract a distance of 1602.99' to the POINT OF
98	98	BEGINNING and containing 50.234 acres, more or less.
99	99	SECTION 2. This Act takes effect September 1, 2013.
