88 A BILL TO BE ENTITLED
99 AN ACT
1010 relating to the transfer of certain state property from the Texas
1111 Juvenile Justice Department to Jefferson County.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. (a) Not later than January 31, 2014, the Texas
1414 Juvenile Justice Department shall donate and transfer to Jefferson
1515 County the real property described by Subsection (e) of this
1616 section.
1717 (b) Jefferson County may use the property transferred under
1818 this Act only for a purpose that benefits the public interest of the
1919 state. If Jefferson County uses the property for any purpose other
2020 than a purpose described by this subsection, ownership of the
2121 property automatically reverts to the Texas Juvenile Justice
2222 Department.
2323 (c) The Texas Juvenile Justice Department shall transfer
2424 the property by an appropriate instrument of transfer. The
2525 instrument of transfer must:
2626 (1) provide that:
2727 (A) Jefferson County may use the property only
2828 for a purpose that benefits the public interest of the state; and
2929 (B) ownership of the property will automatically
3030 revert to the Texas Juvenile Justice Department if Jefferson County
3131 uses the property for any purpose other than a purpose described by
3232 Paragraph (A) of this subdivision; and
3333 (2) describe the property to be transferred by metes
3434 and bounds.
3535 (d) The Texas Juvenile Justice Department shall retain
3636 custody of the instrument of transfer after the instrument of
3737 transfer is filed in the real property records of Jefferson County.
3838 (e) The real property referred to in this section is
3939 described as follows:
4040 Field note description of a 50.234 acre tract of land in the
4141 T. & N.O.R.R. Survey, Section No. 1, Abstract No. 257 and the W.M.
4242 Carrol Survey, Abstract No. 13, Jefferson County, Texas. BEING a
4343 50.234 acre tract or parcel of land out of and a part of tracts 15-A
4444 and 14-A of the partition map no. 2 of the McFaddin Trust as
4545 recorded in Vol. 7, Pg. 133, of the map records of Jefferson County,
4646 said tract 15-A being conveyed to Jefferson County by that certain
4747 deed from J.L. Caldwell Company Trust as recorded on film code no.
4848 102-98-2140, tract no. 14-A from Divernon M. Berly to Jefferson
4949 County as recorded on film code no. 102-98-2006, Jefferson County
5050 deed records, said 50.234 acre tract being more fully described by
5151 metes and bounds as follows:
5252 For a locative corner, a Gulf States Utilities Company
5353 concrete monument found at the intersection of the Southerly line
5454 of said tract 15-A and the Westerly Right-of-Way line of U.S.
5555 Highway 69,96 and 287 (338 feet wide). Said monument also being the
5656 Southeast corner of a Gulf States Utilities Company fee strip (198
5757 feet wide) as recorded in Vol. 1586, Pg. 196 of the Deed Records of
5858 Jefferson County, Texas;
5959 THENCE North 23 degrees 37' 09" West with the Westerly
6060 Right-of-Way line of said Highway for a distance of 216.64' to a
6161 1/2" iron rod found at the intersection of the Northerly line of
6262 said fee strip and the Westerly Right-of-Way line of said Highway
6363 and being the Southeast corner of that certain tract described in
6464 deed from J.L. Caldwell Company Trust to Jefferson County and
6565 recorded of film code no. 102-98-2140, Jefferson County Deed
6666 Records;
6767 THENCE North 23 degrees 57' 31" West along the Westerly
6868 Right-of-Way line of said Highway and the Easterly line of tract
6969 15-A for a distance of 1098.15' to a 1/2" iron rod set for the
7070 Southeast corner of the herein described tract and THE PLACE OF
7171 BEGINNING;
7272 THENCE North 79 degrees 06' 40" West a distance of 1462.25' to
7373 an iron rod set for the Southwest corner of the herein described
7474 tract;
7575 THENCE North 23 degrees 57' 31" West 1200' from and parallel
7676 to the Westerly Right-of-Way line of U.S. Highway 69,96 and 287 for
7777 a distance of 1825.0' to an iron rod set for the Northwest corner of
7878 the herein described tract, said corner being located in the
7979 Northerly line of the Jefferson County 250 acre tract and the
8080 Southerly line of a 689.690 acre tract from Jefferson County to the
8181 Texas Department of Criminal Justice and described in deed on film
8282 code no. 102-98-2207, Jefferson County Deed Records;
8383 THENCE South 79 degrees 06' 40" East along the Northerly line
8484 of said Jefferson County 250 acre tract and the Southerly line of
8585 the Texas Department of Criminal Justice 689.690 acre tract for a
8686 distance of 1442.66' to a 3.25" aluminum disk set in the Southerly
8787 Right-of-Way line of proposed F.M. 3514 as described in a donation
8888 deed from Jefferson County to the Texas Department of
8989 Transportation and recorded on film code no. 104-16-1046, Jefferson
9090 County Deed Records;
9191 THENCE South 27 degrees 54' 08" East along the proposed South
9292 Right-of-Way line of F.M. 3514 a distance of 233.76' to a 3.25"
9393 aluminum disk set in the existing Right-of-Way line of U.S. Highway
9494 69.96 and 287;
9595 THENCE South 23 degrees 57' 31" East along the Westerly
9696 Right-of-Way line of said Highway and the Easterly line of the
9797 herein described tract a distance of 1602.99' to the POINT OF
9898 BEGINNING and containing 50.234 acres, more or less.
9999 SECTION 2. This Act takes effect September 1, 2013.
