83R9376 SCL-F By: Perry H.B. No. 1988 A BILL TO BE ENTITLED AN ACT relating to the use of corrugated stainless steel tubing in residential and commercial structures. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 766.001, Health and Safety Code, is amended by adding Subdivisions (1-a) and (4-a) to read as follows: (1-a) "Corrugated stainless steel tubing" means a type of conduit that is meant for the transport of natural gas with residential structure application and consists of corrugated stainless steel or another similar corrugated conduit identified by state fire marshal order. (4-a) "Residential dwelling" means a structure that has one or more residential units that are occupied as, or designed or intended for occupancy as, a residence by individuals. SECTION 2. Chapter 766, Health and Safety Code, is amended by adding Section 766.004 to read as follows: Sec. 766.004. REQUIREMENTS ON USE OF CORRUGATED STAINLESS STEEL TUBING. Corrugated stainless steel tubing in each residential dwelling constructed in this state must conform to the standards of the 2008 International Residential Code or to a version of that code that is adopted by ordinance of the largest municipality in the county in which the dwelling is located and that is at least as stringent as the 2008 version of that code. SECTION 3. Subtitle A, Title 9, Health and Safety Code, is amended by adding Chapter 766A to read as follows: CHAPTER 766A. FIRE SAFETY IN COMMERCIAL STRUCTURES Sec. 766A.001. DEFINITIONS. In this chapter: (1) "Commercial structure" means a structure that is occupied for, or designed or intended for occupancy for, a commercial purpose. (2) "Corrugated stainless steel tubing" means a type of conduit that is meant for the transport of natural gas with commercial structure application and consists of corrugated stainless steel or another similar corrugated conduit identified by state fire marshal order. Sec. 766A.002. REQUIREMENTS ON USE OF CORRUGATED STAINLESS STEEL TUBING. Corrugated stainless steel tubing in each commercial structure constructed in this state must conform to the minimum standards adopted by state fire marshal order. SECTION 4. The change in law made by this Act applies only to corrugated stainless steel tubing installed in a structure on or after the effective date of this Act. Corrugated stainless steel tubing installed before the effective date of this Act is governed by the law in effect on the date the tubing was installed, and that law is continued in effect for that purpose. SECTION 5. This Act takes effect September 1, 2013.
