99 AN ACT
1010 relating to the receipt or consideration of a petition requesting
1111 detachment and annexation by the board of trustees of a school
1212 district after adoption of consolidation resolutions.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter D, Chapter 13, Education Code, is
1515 amended by adding Section 13.1521 to read as follows:
1616 Sec. 13.1521. RECEIPT OR CONSIDERATION OF PETITION
1717 REQUESTING DETACHMENT AND ANNEXATION AFTER ADOPTION OF
1818 CONSOLIDATION RESOLUTIONS. If a resolution in favor of
1919 consolidation has been adopted by the board of trustees of each
2020 school district proposed to be consolidated into a particular
2121 single district, none of those boards of trustees may receive or
2222 consider a petition requesting detachment and annexation under
2323 Subchapter B without the consent of each of the other of those
2424 boards of trustees:
2525 (1) before consolidation; or
2626 (2) before consolidation is disapproved at an election
2727 under Section 13.153.
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2013.
