| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 253.001, Local Government Code, is |
|---|
| 14 | 14 | | amended by adding Subsections (m) and (n) to read as follows: |
|---|
| 15 | 15 | | (m) Subsection (b) does not apply to the sale of a public |
|---|
| 16 | 16 | | square or park if the land: |
|---|
| 17 | 17 | | (1) was part of the site of a world exposition |
|---|
| 18 | 18 | | recognized by the Bureau International des Expositions; and |
|---|
| 19 | 19 | | (2) has a total area of dedicated public square or park |
|---|
| 20 | 20 | | of 20 acres or more. |
|---|
| 21 | 21 | | (n) A petition for judicial review of a sale under |
|---|
| 22 | 22 | | Subsection (m) must be filed on or before the 180th day after the |
|---|
| 23 | 23 | | date the ordinance or resolution authorizing the sale is adopted. A |
|---|
| 24 | 24 | | petition filed after that date is barred. |
|---|
| 25 | 25 | | SECTION 2. Chapter 253, Local Government Code, is amended |
|---|
| 26 | 26 | | by adding Section 253.0011 to read as follows: |
|---|
| 27 | 27 | | Sec. 253.0011. SALE OR LEASE OF LAND USED FOR WORLD |
|---|
| 28 | 28 | | EXPOSITION RESTRICTED. (a) If a municipality or local government |
|---|
| 29 | 29 | | corporation sells land as authorized by Section 253.001(m): |
|---|
| 30 | 30 | | (1) the land may not be used to develop and construct a |
|---|
| 31 | 31 | | hotel; and |
|---|
| 32 | 32 | | (2) other land that the municipality or local |
|---|
| 33 | 33 | | government corporation owns that was part of the site of a world |
|---|
| 34 | 34 | | exposition recognized by the Bureau International des Expositions |
|---|
| 35 | 35 | | may not be sold, leased, or otherwise used to develop and construct |
|---|
| 36 | 36 | | a hotel. |
|---|
| 37 | 37 | | (b) Subsection (a) does not apply to land owned by an |
|---|
| 38 | 38 | | institution of higher education on January 1, 2013. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 43 | | Act takes effect September 1, 2013. |
