99 AN ACT
1010 relating to the sale and use of certain land used for a world
1111 exposition.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 253.001, Local Government Code, is
1414 amended by adding Subsections (m) and (n) to read as follows:
1515 (m) Subsection (b) does not apply to the sale of a public
1616 square or park if the land:
1717 (1) was part of the site of a world exposition
1818 recognized by the Bureau International des Expositions; and
1919 (2) has a total area of dedicated public square or park
2020 of 20 acres or more.
2121 (n) A petition for judicial review of a sale under
2222 Subsection (m) must be filed on or before the 180th day after the
2323 date the ordinance or resolution authorizing the sale is adopted. A
2424 petition filed after that date is barred.
2525 SECTION 2. Chapter 253, Local Government Code, is amended
2626 by adding Section 253.0011 to read as follows:
2727 Sec. 253.0011. SALE OR LEASE OF LAND USED FOR WORLD
2828 EXPOSITION RESTRICTED. (a) If a municipality or local government
2929 corporation sells land as authorized by Section 253.001(m):
3030 (1) the land may not be used to develop and construct a
3131 hotel; and
3232 (2) other land that the municipality or local
3333 government corporation owns that was part of the site of a world
3434 exposition recognized by the Bureau International des Expositions
3535 may not be sold, leased, or otherwise used to develop and construct
3636 a hotel.
3737 (b) Subsection (a) does not apply to land owned by an
3838 institution of higher education on January 1, 2013.
3939 SECTION 3. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2013.
