66 AN ACT
77 relating to the transfer of alcoholic beverages for manufacturing
88 purposes between certain permit and license holders.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 14.01(a), Alcoholic Beverage Code, is
1111 amended to read as follows:
1212 (a) The holder of a distiller's and rectifier's permit may:
1313 (1) manufacture distilled spirits;
1414 (2) rectify, purify, and refine distilled spirits and
1515 wines;
1616 (3) mix wines, distilled spirits, or other liquors;
1717 (4) bottle, label, and package the permit holder's
1818 finished products;
1919 (5) sell the finished products in this state to
2020 holders of wholesaler's permits and to qualified persons outside
2121 the state;
2222 (6) purchase [import] distilled spirits, to be used
2323 only for manufacturing or rectification purposes, from holders of
2424 nonresident seller's permits or distiller's and rectifier's
2525 permits; and
2626 (7) dispense free distilled spirits for consumption on
2727 the permitted premises.
2828 SECTION 2. Subchapter D, Chapter 109, Alcoholic Beverage
2929 Code, is amended by adding Section 109.63 to read as follows:
3030 Sec. 109.63. BULK TRANSFERS BETWEEN CERTAIN PERMITTEES AND
3131 LICENSEES. (a) This section applies to the holder of a brewer's
3232 permit, distiller's and rectifier's permit, winery permit, wine
3333 bottler's permit, or manufacturer's license.
3434 (b) Notwithstanding any other provision of this code, a
3535 permittee or licensee described by Subsection (a) may transfer in
3636 bulk an alcoholic beverage produced by the permittee or licensee to
3737 any other permittee or licensee described by that subsection
3838 provided that:
3939 (1) the alcoholic beverage transferred is used only
4040 for manufacturing purposes by the recipient; and
4141 (2) the transfer is permitted by federal law.
4242 SECTION 3. This Act takes effect September 1, 2013.
