By: Workman H.B. No. 2083 A BILL TO BE ENTITLED AN ACT relating to the appropriation of service fees collected by the state and distributed to regional planning commissions via the commission. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 771, Health and Safety Code, is amended by adding Subsections (g) and (h) to read as follows: (g) All funds collected under this section shall be appropriated and used for the purpose for which they were collected. The comptroller shall not divert these funds for any other purpose nor shall these funds be allowed to accumulate to an amount greater than ten percent of the estimated annual collection. The commission shall distribute funds to the regional planning commissions in proportion to the geographic region in which they were collected. (h) The comptroller shall deposit funds previously collected under this chapter into the general revenue fund of the state, except that the comptroller shall leave within the account an amount equal to ten percent of the estimated revenues for the 2014-2015 biennium. SECTION 2. Section 771.0711, Health and Safety Code, is amended by adding Subsection (k) to read as follows: (k) All funds collected under this section shall be appropriated and used for the purpose for which they were collected. The comptroller shall not divert these funds for any other purpose nor shall these funds be allowed to accumulate to an amount greater than ten percent of the estimated annual collection. The commission shall distribute funds to the regional planning commissions in proportion to the geographic region in which they were collected. SECTION 3. Section 771.0712, Health and Safety Code, is amended by adding Subsections (e) and (f) to read as follows: (e) All funds collected under this section shall be appropriated and used for the purpose for which they were collected. The comptroller shall not divert these funds for any other purpose nor shall these funds be allowed to accumulate to an amount greater than ten percent of the estimated annual collection. The commission shall distribute funds to the regional planning commissions in proportion to the geographic region in which they were collected. SECTION 4. This Act takes effect September 1, 2013.
