99 AN ACT
1010 relating to municipally owned utility systems; authorizing the
1111 imposition of fees by a utility board of trustees.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 1502.002(a), Government Code, is amended
1414 to read as follows:
1515 (a) A municipality may acquire, purchase, construct,
1616 improve, enlarge, equip, operate, or maintain any property,
1717 including channels or bodies of water known as resacas, interests
1818 in property, buildings, structures, activities, services,
1919 operations, or other facilities, with respect to:
2020 (1) a utility system;
2121 (2) a park; or
2222 (3) a swimming pool.
2323 SECTION 2. Section 1502.057, Government Code, is amended by
2424 adding Subsection (c) to read as follows:
2525 (c) The board of trustees having management and control of a
2626 utility system located in a county contiguous to the Gulf of Mexico
2727 and bordering the United Mexican States may impose and collect the
2828 charges authorized under this section for services provided by the
2929 utility system.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2013.
