99 AN ACT
1010 relating to procedures for the dissolution of the Hamlin Hospital
1111 District; authorizing the imposition of a tax.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 1037, Special District Local Laws Code,
1414 is amended by adding Subchapter G to read as follows:
1515 SUBCHAPTER G. DISSOLUTION
1616 Sec. 1037.301. DISSOLUTION; ELECTION. (a) The district
1717 may be dissolved only on approval of a majority of the district
1818 voters voting in an election held for that purpose.
1919 (b) The board may order an election on the question of
2020 dissolving the district and disposing of the district's assets and
2121 obligations.
2222 (c) The board shall order an election if the board receives
2323 a petition requesting an election that is signed by at least 15
2424 percent of the registered voters in the district.
2525 (d) The election must be ordered in accordance with Section
2626 3.005, Election Code. The order calling the election must state:
2727 (1) the nature of the election, including the
2828 proposition to appear on the ballot;
2929 (2) the date of the election;
3030 (3) the hours during which the polls will be open; and
3131 (4) the location of the polling places.
3232 Sec. 1037.302. NOTICE OF ELECTION. (a) The board shall
3333 give notice of an election under this subchapter by publishing once
3434 a week for two consecutive weeks a substantial copy of the election
3535 order in a newspaper with general circulation in the district.
3636 (b) The first publication of the notice must appear not
3737 later than the 35th day before the date set for the election.
3838 Sec. 1037.303. BALLOT. The ballot for an election under
3939 this subchapter must be printed to permit voting for or against the
4040 proposition: "The dissolution of the Hamlin Hospital District."
4141 Sec. 1037.304. ELECTION RESULTS. (a) If a majority of the
4242 votes in an election under this subchapter favor dissolution, the
4343 board shall find that the district is dissolved.
4444 (b) If a majority of the votes in the election do not favor
4545 dissolution, the board shall continue to administer the district
4646 and another election on the question of dissolution may not be held
4747 before the first anniversary of the date of the most recent election
4848 to dissolve the district.
4949 Sec. 1037.305. TRANSFER, SALE, OR ADMINISTRATION OF ASSETS.
5050 (a) If a majority of the votes in an election held under this
5151 subchapter favor dissolution, the board shall:
5252 (1) transfer the land, buildings, improvements,
5353 equipment, and other assets that belong to the district to Jones
5454 County or another governmental entity in Jones County;
5555 (2) sell the assets and liabilities to another person;
5656 or
5757 (3) administer the property, assets, and debts until
5858 all money has been disposed of and all district debts have been paid
5959 or settled.
6060 (b) If the board makes the transfer under Subsection (a)(1),
6161 the county or entity assumes all debts and obligations of the
6262 district at the time of the transfer, and the district is dissolved.
6363 (c) If Subsections (a)(1) and (2) do not apply and the board
6464 administers the property, assets, and debts of the district under
6565 Subsection (a)(3), the district is dissolved when all money has
6666 been disposed of and all district debts have been paid or settled.
6767 Sec. 1037.306. SALE OR TRANSFER OF ASSETS AND LIABILITIES.
6868 (a) The dissolution of the district and the sale or transfer of the
6969 district's assets and liabilities to another person may not
7070 contravene a trust indenture or bond resolution relating to the
7171 district's outstanding bonds. The dissolution and sale or
7272 transfer does not diminish or impair the rights of a holder of an
7373 outstanding bond, warrant, or other obligation of the district.
7474 (b) The sale or transfer of the district's assets and
7575 liabilities must satisfy the debt and bond obligations of the
7676 district in a manner that protects the interests of district
7777 residents, including the residents' collective property rights in
7878 the district's assets.
7979 (c) The district may not transfer or dispose of the
8080 district's assets except for due compensation unless:
8181 (1) the transfer is made to another governmental
8282 entity that serves the district; and
8383 (2) the transferred assets are to be used for the
8484 benefit of the district's residents.
8585 Sec. 1037.307. IMPOSITION OF TAX AND RETURN OF SURPLUS
8686 TAXES. (a) After the board finds that the district is dissolved,
8787 the board shall:
8888 (1) determine the debt owed by the district; and
8989 (2) impose on the property included in the district's
9090 tax rolls a tax that is in proportion of the debt to the property
9191 value.
9292 (b) On the payment of all outstanding debts and obligations
9393 of the district, the board shall order the secretary to return to
9494 each district taxpayer the taxpayer's pro rata share of all unused
9595 tax money.
9696 (c) A taxpayer may request that the taxpayer's share of
9797 surplus tax money be credited to the taxpayer's county taxes. If a
9898 taxpayer requests the credit, the board shall direct the secretary
9999 to transmit the money to the county tax assessor-collector.
100100 Sec. 1037.308. REPORT; DISSOLUTION ORDER. (a) After the
101101 district has paid all district debts and has disposed of all
102102 district money and other assets as prescribed by this subchapter,
103103 the board shall file a written report with the Commissioners Court
104104 of Jones County summarizing the board's actions in dissolving the
105105 district.
106106 (b) Not later than the 10th day after the date the
107107 Commissioners Court of Jones County receives the report and
108108 determines that the requirements of this subchapter have been
109109 fulfilled, the commissioners court shall enter an order dissolving
110110 the district and releasing the board from any further duty or
111111 obligation.
112112 SECTION 2. This Act takes effect September 1, 2013.
