| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Subchapter A, Chapter 25, Education Code, is |
|---|
| 15 | 15 | | amended by adding Section 25.008 to read as follows: |
|---|
| 16 | 16 | | Sec. 25.008. ENROLLMENT IN SUMMER SCHOOL COURSE BY PERSON |
|---|
| 17 | 17 | | NOT ENROLLED IN DISTRICT. (a) Except as provided by Subsection |
|---|
| 18 | 18 | | (b), a school district shall permit a person who is eligible under |
|---|
| 19 | 19 | | Section 25.001 to attend school in the district but who is not |
|---|
| 20 | 20 | | enrolled in school in the district to enroll in a district summer |
|---|
| 21 | 21 | | school course on the same basis as a district student, including: |
|---|
| 22 | 22 | | (1) satisfaction of any course eligibility |
|---|
| 23 | 23 | | requirement; and |
|---|
| 24 | 24 | | (2) payment of any fee authorized under Section 11.158 |
|---|
| 25 | 25 | | that is charged in connection with the course. |
|---|
| 26 | 26 | | (b) Subsection (a) does not apply to enrollment in a program |
|---|
| 27 | 27 | | under Section 29.088, 29.090, or 29.098 or in a similar intensive |
|---|
| 28 | 28 | | program. |

| 29 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2013. |
