99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the abolition of wind erosion conservation districts.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 202, Agriculture Code, is repealed.
1414 SECTION 2. (a) The county judge of each county in this state
1515 in which a wind erosion conservation district is located or the
1616 judge's designee shall proceed with the dissolution of the district
1717 as soon as possible.
1818 (b) The county judge or the judge's designee shall conduct
1919 an inventory of the assets of the wind erosion conservation
2020 district and determine the debt owed by the district.
2121 (c) The county judge or the judge's designee shall control
2222 and administer the property, funds, and other assets and the debts
2323 of the wind erosion conservation district until all assets have
2424 been disposed of and all debts, including outstanding bonds, of the
2525 district have been paid or settled.
2626 (d) After the county judge or the judge's designee has paid
2727 all debts and has disposed of all assets of the wind erosion
2828 conservation district as prescribed by this section, the county
2929 judge or the judge's designee shall:
3030 (1) transfer to the county in which the district is
3131 located all net proceeds of the disposal of the assets; and
3232 (2) file a written report with the commissioners court
3333 of the county setting forth a summary of the county judge's or the
3434 judge's designee's actions in dissolving the district.
3535 (e) Not later than the 10th day after the date the
3636 commissioners court receives the report under Subsection (d)(2) of
3737 this section and determines that the requirements of this section
3838 have been fulfilled, the commissioners court shall enter an order
3939 dissolving the district.
4040 SECTION 3. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2013.
