10	10	relating to eligibility of certain dependents for coverage under
11	11	the state employee group benefits program.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Section 1551.004(a), Insurance Code, is amended
14	14	to read as follows:
15	15	(a) In this chapter, "dependent" with respect to an
16	16	individual eligible to participate in the group benefits program
17	17	means the individual's:
18	18	(1) spouse;
19	19	(2) unmarried child younger than 26 years of age;
20	20	(3) child of any age who the board of trustees
21	21	determines lives with or has the child's care provided by the
22	22	individual on a regular basis if[:
23	23	[(A)] the child is mentally or physically
24	24	incapacitated to the extent that the child is dependent on the
25	25	individual for care or support, as determined by the board of
26	26	trustees;
27	27	[(B) the child's coverage under this chapter has
28	28	not lapsed; and
29	29	[(C) the child is at least 26 years old and:
30	30	[(i) was enrolled as a participant in the
31	31	health benefits coverage under the group benefits program on the
32	32	date of the child's 26th birthday; or
33	33	[(ii) on the date the individual became
34	34	eligible to participate in the group benefits program, was enrolled
35	35	as the individual's dependent in health benefits coverage under
36	36	Chapter 1575, 1579, or 1601 or in continuation of that dependent
37	37	coverage under the Consolidated Omnibus Budget Reconciliation Act
38	38	of 1985 (Pub. L. No. 99-272) and its subsequent amendments;]
39	39	(4) child of any age who is unmarried, for purposes of
40	40	health benefit coverage under this chapter, on expiration of the
41	41	child's continuation coverage under the Consolidated Omnibus
42	42	Budget Reconciliation Act of 1985 (Pub. L. No. 99-272) and its
43	43	subsequent amendments; and
44	44	(5) ward, as that term is defined by Section 601, Texas
45	45	Probate Code, who is 26 years of age or younger.
46	46	SECTION 2. This Act takes effect immediately if it receives
47	47	a vote of two-thirds of all the members elected to each house, as
48	48	provided by Section 39, Article III, Texas Constitution. If this
49	49	Act does not receive the vote necessary for immediate effect, this
50	50	Act takes effect September 1, 2013.
