99 AN ACT
1010 relating to eligibility of certain dependents for coverage under
1111 the state employee group benefits program.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 1551.004(a), Insurance Code, is amended
1414 to read as follows:
1515 (a) In this chapter, "dependent" with respect to an
1616 individual eligible to participate in the group benefits program
1717 means the individual's:
1818 (1) spouse;
1919 (2) unmarried child younger than 26 years of age;
2020 (3) child of any age who the board of trustees
2121 determines lives with or has the child's care provided by the
2222 individual on a regular basis if[:
2323 [(A)] the child is mentally or physically
2424 incapacitated to the extent that the child is dependent on the
2525 individual for care or support, as determined by the board of
2626 trustees;
2727 [(B) the child's coverage under this chapter has
2828 not lapsed; and
2929 [(C) the child is at least 26 years old and:
3030 [(i) was enrolled as a participant in the
3131 health benefits coverage under the group benefits program on the
3232 date of the child's 26th birthday; or
3333 [(ii) on the date the individual became
3434 eligible to participate in the group benefits program, was enrolled
3535 as the individual's dependent in health benefits coverage under
3636 Chapter 1575, 1579, or 1601 or in continuation of that dependent
3737 coverage under the Consolidated Omnibus Budget Reconciliation Act
3838 of 1985 (Pub. L. No. 99-272) and its subsequent amendments;]
3939 (4) child of any age who is unmarried, for purposes of
4040 health benefit coverage under this chapter, on expiration of the
4141 child's continuation coverage under the Consolidated Omnibus
4242 Budget Reconciliation Act of 1985 (Pub. L. No. 99-272) and its
4343 subsequent amendments; and
4444 (5) ward, as that term is defined by Section 601, Texas
4545 Probate Code, who is 26 years of age or younger.
4646 SECTION 2. This Act takes effect immediately if it receives
4747 a vote of two-thirds of all the members elected to each house, as
4848 provided by Section 39, Article III, Texas Constitution. If this
4949 Act does not receive the vote necessary for immediate effect, this
5050 Act takes effect September 1, 2013.
