| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. The heading to Section 1903.256, Occupations |
|---|
| 13 | 13 | | Code, is amended to read as follows: |
|---|
| 14 | 14 | | Sec. 1903.256. UNLICENSED [INSTALLATION OF] IRRIGATION |
|---|
| 15 | 15 | | SYSTEM SERVICES [WITHOUT LICENSE]; OFFENSE. |
|---|
| 16 | 16 | | SECTION 2. Section 1903.256, Occupations Code, is amended |
|---|
| 17 | 17 | | by amending Subsection (a) and adding Subsection (a-1) to read as |
|---|
| 18 | 18 | | follows: |
|---|
| 19 | 19 | | (a) Unless exempt under Section 1903.002, a person commits |
|---|
| 20 | 20 | | an offense if the person sells, designs, installs, maintains, |
|---|
| 21 | 21 | | alters, repairs, services, or provides consultation services for an |
|---|
| 22 | 22 | | irrigation system, including the connection of an irrigation system |
|---|
| 23 | 23 | | to a water supply, without holding a license issued by the |
|---|
| 24 | 24 | | commission under Chapter 37, Water Code. |
|---|
| 25 | 25 | | (a-1) Unless exempt under Section 1903.002, a person |
|---|
| 26 | 26 | | commits an offense if the person, without holding a license issued |
|---|
| 27 | 27 | | by the commission under Chapter 37, Water Code: |
|---|
| 28 | 28 | | (1) advertises or offers to perform the services |
|---|
| 29 | 29 | | described by Subsection (a); or |
|---|
| 30 | 30 | | (2) represents to another person that the person is an |
|---|
| 31 | 31 | | irrigator. |
|---|
| 32 | 32 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 33 | 33 | | to an offense committed on or after the effective date of this Act. |
|---|
| 34 | 34 | | An offense committed before the effective date of this Act is |
|---|
| 35 | 35 | | covered by the law in effect on the date the offense was committed, |
|---|
| 36 | 36 | | and the former law is continued in effect for that purpose. For |
|---|
| 37 | 37 | | purposes of this section, an offense was committed before the |
|---|
| 38 | 38 | | effective date of this Act if any element of the offense occurred |
|---|
| 39 | 39 | | before that date. |
|---|
| 40 | 40 | | SECTION 4. This Act takes effect September 1, 2013. |
