99 relating to health benefit plan coverage for certain nonemergency
1010 ambulance transportation services.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 1451, Insurance Code, is amended by
1313 adding Subchapter J to read as follows:
1414 SUBCHAPTER J. ACCESS TO TRANSPORTATION SERVICES
1515 Sec. 1451.451. APPLICABILITY. This subchapter applies only
1616 to a health benefit plan that provides benefits for nonemergency
1717 ambulance transportation services and that:
1818 (1) provides benefits for medical or surgical expenses
1919 incurred as a result of a health condition, accident, or sickness,
2020 including:
2121 (A) an individual, group, blanket, or franchise
2222 insurance policy or insurance agreement, a group hospital service
2323 contract, or an individual or group evidence of coverage or similar
2424 coverage document that is offered by:
2525 (i) an insurance company;
2626 (ii) a group hospital service corporation
2727 operating under Chapter 842;
2828 (iii) a fraternal benefit society operating
2929 under Chapter 885;
3030 (iv) a stipulated premium company operating
3131 under Chapter 884; or
3232 (v) a health maintenance organization
3333 operating under Chapter 843; and
3434 (B) to the extent permitted by the Employee
3535 Retirement Income Security Act of 1974 (29 U.S.C. Section 1001 et
3636 seq.), a health benefit plan that is offered by:
3737 (i) a multiple employer welfare arrangement
3838 as defined by Section 3 of that Act; or
3939 (ii) another analogous benefit
4040 arrangement;
4141 (2) is offered by:
4242 (A) an approved nonprofit health corporation
4343 that holds a certificate of authority under Chapter 844; or
4444 (B) an entity that is not authorized under this
4545 code or another insurance law of this state that contracts directly
4646 for health care services on a risk-sharing basis, including a
4747 capitation basis; or
4848 (3) provides health and accident coverage through a
4949 risk pool created under Chapter 172, Local Government Code,
5050 notwithstanding Section 172.014, Local Government Code, or any
5151 other law.
5252 Sec. 1451.452. EXCEPTION. This subchapter does not apply
5353 to:
5454 (1) a plan that provides coverage:
5555 (A) only for a specified disease;
5656 (B) only for accidental death or dismemberment;
5757 (C) for wages or payments instead of wages for a
5858 period during which an employee is absent from work because of
5959 sickness or injury; or
6060 (D) as a supplement to a liability insurance
6161 policy;
6262 (2) a small employer health benefit plan under Chapter
6363 1501;
6464 (3) a Medicare supplemental policy as defined by
6565 Section 1882(g)(1), Social Security Act (42 U.S.C. Section 1395ss);
6666 (4) a workers' compensation insurance policy;
6767 (5) medical payment insurance coverage provided under
6868 a motor vehicle insurance policy; or
6969 (6) a long-term care insurance policy, including a
7070 nursing home fixed indemnity policy, unless the commissioner
7171 determines that the policy provides benefit coverage so
7272 comprehensive that the policy is a health benefit plan described by
7373 Section 1451.451.
7474 Sec. 1451.453. RULES. The commissioner shall adopt rules
7575 necessary to implement this subchapter.
7676 Sec. 1451.454. LIMITS ON NONEMERGENCY AMBULANCE
7777 TRANSPORTATION PROVIDERS. (a) The issuer of a health benefit plan
7878 that provides coverage for nonemergency ambulance transportation
7979 services may not contract with a nonemergency ambulance
8080 transportation service provider who has a direct or indirect
8181 ownership interest in a transportation brokerage service that
8282 contracts with the plan and provides for the establishment of a
8383 nonemergency ambulance transportation network.
8484 (b) Subsection (a) does not apply to nonemergency ambulance
8585 transportation services provided in an area of the state in which
8686 there is only one nonemergency ambulance transportation service
8787 provider available to provide the transportation service needed. A
8888 health benefit plan that provides coverage for nonemergency
8989 ambulance transportation services under this subsection shall
9090 maintain documentation evidencing that no other provider is
9191 available to provide the service in the area.
9292 Sec. 1451.455. LIMITS ON PAYMENTS. A transportation
9393 service provider may not offer or make any payment or other form of
9494 remuneration, including any kickback, rebate, cash, gift, or
9595 service in kind, to the issuer of a health benefit plan for
9696 referrals to the provider, or for contracting with the provider, to
9797 provide nonemergency ambulance transportation services.
9898 SECTION 2. The change in law made by this Act applies only
9999 to a health benefit plan delivered, issued for delivery, or renewed
100100 on or after January 1, 2014. A plan delivered, issued for delivery,
101101 or renewed before January 1, 2014, is governed by the law in effect
102102 immediately before the effective date of this Act, and that law is
103103 continued in effect for that purpose.
104104 SECTION 3. This Act takes effect September 1, 2013.
