 A BILL TO BE ENTITLED
 AN ACT
 relating to the authority of the Texas Commission on Environmental
 Quality to create a groundwater conservation district in certain
 counties.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 36.0151(f), Water Code, is amended to
 read as follows:
 (f)  The [Before September 1, 2015, the] commission may not
 create a groundwater conservation district under this section in a
 county:
 (1)  in which the annual amount of surface water used is
 more than 50 times the annual amount of groundwater produced;
 (2)  that is located in a priority groundwater
 management area; and
 (3)  that has a population greater than 2.3 million.
 SECTION 2.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2013.
