99 relating to sworn affidavits provided to support the issuance of a
1010 search warrant.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article 18.01(b), Code of Criminal Procedure, is
1313 amended to read as follows:
1414 (b)(1) No search warrant shall issue for any purpose in this
1515 state unless sufficient facts are first presented to satisfy the
1616 issuing magistrate that probable cause does in fact exist for its
1717 issuance. A sworn affidavit setting forth substantial facts
1818 establishing probable cause shall be provided [filed] in every
1919 instance in which a search warrant is requested.
2020 (2) For purposes of this article, a magistrate may
2121 accept a sworn statement that is provided by telephone or other
2222 appropriate and reliable means of wire or electronic communication.
2323 A magistrate or the magistrate's designee shall fully document a
2424 sworn affidavit provided by telephone. A magistrate or the
2525 magistrate's designee may electronically record and preserve any
2626 statement communicated orally under this subdivision.
2727 (3) Except as provided by Article 18.011, the
2828 affidavit is public information if executed, and the magistrate's
2929 clerk shall make a copy of the affidavit available for public
3030 inspection in the clerk's office during normal business hours.
3131 SECTION 2. The change in law made by this Act applies only
3232 to a search warrant that is issued on or after the effective date of
3333 this Act. A search warrant that was issued before the effective
3434 date of this Act is governed by the law in effect on the date the
3535 warrant was issued, and the former law is continued in effect for
3636 that purpose.
3737 SECTION 3. This Act takes effect September 1, 2013.
