| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 87.041(e), Election Code, is amended to |
|---|
| 14 | 14 | | read as follows: |

| 15 | 15 | | (e) In making the determination under Subsection (b)(2), |
|---|
| 16 | 16 | | the board may also compare the signatures with any two or more |
|---|
| 17 | 17 | | signatures of the voter made within the preceding six years and on |
|---|
| 18 | 18 | | file with the voter registrar [the signature on the voter's |
|---|
| 19 | 19 | | registration application] to confirm that the signatures are those |
|---|
| 20 | 20 | | of the same person but may not use the signatures [registration |
|---|
| 21 | 21 | | application signature] to determine that the signatures are not |
|---|
| 22 | 22 | | those of the same person. |

| 23 | 23 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2013. |
