| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. The heading to Section 521.1655, Transportation |
|---|
| 14 | 14 | | Code, is amended to read as follows: |
|---|
| 15 | 15 | | Sec. 521.1655. TESTING BY DRIVER EDUCATION SCHOOL AND |
|---|
| 16 | 16 | | CERTAIN DRIVER EDUCATION COURSE PROVIDERS. |
|---|
| 17 | 17 | | SECTION 2. Section 521.1655, Transportation Code, is |
|---|
| 18 | 18 | | amended by adding Subsection (a-1) to read as follows: |
|---|
| 19 | 19 | | (a-1) A driver education course provider approved under |
|---|
| 20 | 20 | | Section 521.205 may administer to a student of that course the |
|---|
| 21 | 21 | | highway sign and traffic law parts of the examination required by |
|---|
| 22 | 22 | | Section 521.161. |

| 23 | 23 | | SECTION 3. Section 521.205(c), Transportation Code, is |
|---|
| 24 | 24 | | amended to read as follows: |
|---|
| 25 | 25 | | (c) The rules must provide a method by which: |
|---|
| 26 | 26 | | (1) approval of a course is obtained; |
|---|
| 27 | 27 | | (2) an applicant submits proof of completion of the |
|---|
| 28 | 28 | | course; [and] |
|---|
| 29 | 29 | | (3) approval for delivering course materials by an |
|---|
| 30 | 30 | | alternative method, including electronic means, is obtained; |
|---|
| 31 | 31 | | (4) a provider of a course approved under this section |
|---|
| 32 | 32 | | may administer to an applicant the highway sign and traffic law |
|---|
| 33 | 33 | | parts of the examination as provided by Section 521.1655(a-1) |
|---|
| 34 | 34 | | through electronic means; and |
|---|
| 35 | 35 | | (5) an applicant submits proof of passage of an |
|---|
| 36 | 36 | | examination administered under Subdivision (4). |
|---|
| 37 | 37 | | SECTION 4. The Department of Public Safety shall adopt the |
|---|
| 38 | 38 | | rules required by Section 521.205, Transportation Code, as amended |
|---|
| 39 | 39 | | by this Act, not later than January 1, 2014. |
|---|
| 40 | 40 | | SECTION 5. This Act takes effect September 1, 2013. |
