99 relating to requiring municipalities to reimburse the Texas
1010 Department of Transportation for compensation paid for certain
1111 signs required to be relocated due to road construction.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 216, Local Government
1414 Code, is amended by adding Section 216.016 to read as follows:
1515 Sec. 216.016. COSTS OF REMOVAL DUE TO ROAD CONSTRUCTION.
1616 (a) If a sign located in a municipality is required to be removed
1717 because of the widening, construction, or reconstruction of a road
1818 by the Texas Department of Transportation and if relocation of the
1919 sign in the municipality would be allowed under department rules
2020 but is restricted or prohibited by charter, ordinance, or a
2121 decision of the municipality, the municipality shall reimburse the
2222 department for any just compensation paid to the owner or lessee of
2323 the sign in a condemnation proceeding.
2424 (b) For purposes of this section, a sign located in the
2525 extraterritorial jurisdiction of a municipality is considered
2626 located in the municipality.
2727 SECTION 2. The change in law made by this Act applies only
2828 to the removal of a sign that occurs on or after the effective date
2929 of this Act.
3030 SECTION 3. This Act takes effect September 1, 2013.
