| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter A, Chapter 216, Local Government |
|---|
| 14 | 14 | | Code, is amended by adding Section 216.016 to read as follows: |
|---|
| 15 | 15 | | Sec. 216.016. COSTS OF REMOVAL DUE TO ROAD CONSTRUCTION. |
|---|
| 16 | 16 | | (a) If a sign located in a municipality is required to be removed |
|---|
| 17 | 17 | | because of the widening, construction, or reconstruction of a road |
|---|
| 18 | 18 | | by the Texas Department of Transportation and if relocation of the |
|---|
| 19 | 19 | | sign in the municipality would be allowed under department rules |
|---|
| 20 | 20 | | but is restricted or prohibited by charter, ordinance, or a |
|---|
| 21 | 21 | | decision of the municipality, the municipality shall reimburse the |
|---|
| 22 | 22 | | department for any just compensation paid to the owner or lessee of |
|---|
| 23 | 23 | | the sign in a condemnation proceeding. |
|---|
| 24 | 24 | | (b) For purposes of this section, a sign located in the |
|---|
| 25 | 25 | | extraterritorial jurisdiction of a municipality is considered |
|---|
| 26 | 26 | | located in the municipality. |
|---|
| 27 | 27 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 28 | 28 | | to the removal of a sign that occurs on or after the effective date |
|---|
| 29 | 29 | | of this Act. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2013. |
