12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 402.009, Government Code, is amended to |
---|
14 | 14 | | read as follows: |
---|
15 | 15 | | Sec. 402.009. AUTHORITY TO EMPLOY AND COMMISSION PEACE |
---|
16 | 16 | | OFFICERS. (a) The attorney general may employ and commission peace |
---|
17 | 17 | | officers as investigators for the limited purpose of assisting the |
---|
18 | 18 | | attorney general in carrying out the duties of that office relating |
---|
19 | 19 | | to prosecution assistance and crime prevention. |
---|
20 | 20 | | (b) The attorney general shall ensure that an investigator |
---|
21 | 21 | | employed as authorized under Subsection (a) is compensated |
---|
22 | 22 | | according to Schedule C of the position classification salary |
---|
23 | 23 | | schedule prescribed by the General Appropriations Act. |
---|
24 | 24 | | SECTION 2. Section 659.301(5), Government Code, is amended |
---|
25 | 25 | | to read as follows: |
---|
26 | 26 | | (5) "State employee" means an individual who: |
---|
27 | 27 | | (A) is a commissioned law enforcement officer of |
---|
28 | 28 | | the Department of Public Safety, the Texas Facilities Commission, |
---|
29 | 29 | | the Texas Alcoholic Beverage Commission, [or] the Texas Department |
---|
30 | 30 | | of Criminal Justice, or the attorney general; |
---|
31 | 31 | | (B) is a commissioned security officer of the |
---|
32 | 32 | | comptroller; |
---|
33 | 33 | | (C) is a law enforcement officer commissioned by |
---|
34 | 34 | | the Parks and Wildlife Commission; |
---|
35 | 35 | | (D) is a commissioned peace officer of an |
---|
36 | 36 | | institution of higher education; |
---|
37 | 37 | | (E) is an employee or official of the Board of |
---|
38 | 38 | | Pardons and Paroles or the parole division of the Texas Department |
---|
39 | 39 | | of Criminal Justice if the employee or official has routine direct |
---|
40 | 40 | | contact with inmates of any penal or correctional institution or |
---|
41 | 41 | | with administratively released prisoners subject to the board's |
---|
42 | 42 | | jurisdiction; |
---|
43 | 43 | | (F) has been certified to the Employees |
---|
44 | 44 | | Retirement System of Texas under Section 815.505 as having begun |
---|
45 | 45 | | employment as a law enforcement officer or custodial officer, |
---|
46 | 46 | | unless the individual has been certified to the system as having |
---|
47 | 47 | | ceased employment as a law enforcement officer or custodial |
---|
48 | 48 | | officer; or |
---|
49 | 49 | | (G) before May 29, 1987, received hazardous duty |
---|
50 | 50 | | pay based on the terms of any state law if the individual holds a |
---|
51 | 51 | | position designated under that law as eligible for the pay. |
---|
52 | 52 | | SECTION 3. (a) The classification officer in the office of |
---|
53 | 53 | | the state auditor shall classify the position of commissioned peace |
---|
54 | 54 | | officer employed as an investigator by the Office of the Attorney |
---|
55 | 55 | | General as a Schedule C position under the Texas Position |
---|
56 | 56 | | Classification Plan, 1961. |
---|
57 | 57 | | (b) The change made by the classification officer as |
---|
58 | 58 | | required by this section applies beginning in the state fiscal |
---|
59 | 59 | | biennium beginning September 1, 2013. |
---|
60 | 60 | | (c) This section expires September 1, 2015. |
---|
61 | 61 | | SECTION 4. This Act takes effect September 1, 2013. |
