10	10	relating to the view of the State Capitol.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Subchapter A, Chapter 3151, Government Code, is
13	13	amended by adding Section 3151.0021 to read as follows:
14	14	Sec. 3151.0021. DEFINITION OF CONGRESS AVENUE VIEW
15	15	CORRIDOR. In this chapter, "Congress Avenue view corridor" means
16	16	all of the area between two lines:
17	17	(1) one of which begins at Texas Plane Coordinate
18	18	X-2817236.98, Y-226449.47 and terminates at Texas Plane Coordinate
19	19	X-2818255.32, Y-229927.70; and
20	20	(2) the second of which begins at Texas Plane
21	21	Coordinate X-2817394.92, Y-226404.24 and terminates at Texas Plane
22	22	Coordinate X-2818441.82, Y-229874.83.
23	23	SECTION 2. The heading to Section 3151.051, Government
24	24	Code, is amended to read as follows:
25	25	Sec. 3151.051. PROHIBITED CONSTRUCTION; CAPITOL VIEW
26	26	CORRIDOR.
27	27	SECTION 3. Subchapter B, Chapter 3151, Government Code, is
28	28	amended by adding Section 3151.0511 to read as follows:
29	29	Sec. 3151.0511. PROHIBITED CONSTRUCTION; CONGRESS AVENUE
30	30	VIEW CORRIDOR. A person may not begin, in the Congress Avenue view
31	31	corridor, construction of a structure:
32	32	(1) on the west side of Congress Avenue that:
33	33	(A) is within 60 feet of Congress Avenue; and
34	34	(B) has a height that exceeds 90 feet; and
35	35	(2) on the east side of Congress Avenue that:
36	36	(A) is within 40 feet of Congress Avenue; and
37	37	(B) has a height that exceeds 90 feet.
38	38	SECTION 4. Section 3151.053, Government Code, is amended to
39	39	read as follows:
40	40	Sec. 3151.053. CONFLICT WITH OTHER [LOCAL] REQUIREMENTS.
41	41	If a requirement of this chapter conflicts with a requirement
42	42	enacted by a municipality or with any other requirement under state
43	43	law, the stricter requirement prevails.
44	44	SECTION 5. This Act takes effect immediately if it receives
45	45	a vote of two-thirds of all the members elected to each house, as
46	46	provided by Section 39, Article III, Texas Constitution. If this
47	47	Act does not receive the vote necessary for immediate effect, this
48	48	Act takes effect September 1, 2013.
