77 relating to the extension of an emergency order for protective
88 services for certain persons who are elderly or have disabilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 48.208(e-2), Human Resources Code, is
1111 amended to read as follows:
1212 (e-2) The court, after notice and a hearing, may extend an
1313 emergency order issued under this section for a period of not more
1414 than 30 days after the date the original emergency order for
1515 protective services would otherwise expire under Subsection (e)
1616 [was rendered]. The court, after notice and a hearing and for good
1717 cause shown, may grant a second extension of an emergency order of
1818 not more than an additional 30 days. The court may not grant more
1919 than two extensions of the original emergency order. An extension
2020 order that ends on a Saturday, Sunday, or legal holiday is
2121 automatically extended to 4 p.m. on the first succeeding business
2222 day. The court may modify or terminate the emergency order on
2323 petition of the department, the incapacitated person, or any person
2424 interested in the person's welfare.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2013.
