99 relating to regulation of traffic in a conservation and reclamation
1010 district by a commissioners court.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 791, Government Code, is
1313 amended by adding Section 791.036 to read as follows:
1414 Sec. 791.036. REGULATION OF TRAFFIC IN CERTAIN DISTRICTS.
1515 (a) This section applies only to a county that has a population of
1616 more than 80,000 and less than 130,000 and borders a county with a
1717 population of more than 2 million and less than 4 million.
1818 (b) The commissioners court of a county may enter into an
1919 interlocal contract with the board of a conservation and
2020 reclamation district organized or operating under Section 52,
2121 Article III, or Section 59, Article XVI, Texas Constitution, to
2222 apply the county's traffic regulations to a public road in the
2323 county that is owned, operated, and maintained by the district if
2424 the commissioners court finds that it is in the county's interest to
2525 regulate traffic on the public road.
2626 SECTION 2. Section 251.151, Transportation Code, is amended
2727 to read as follows:
2828 Sec. 251.151. AUTHORITY OF COMMISSIONERS COURT TO REGULATE
2929 CERTAIN ROADS. (a) The commissioners court of a county may
3030 regulate traffic on a county road or on real property owned by the
3131 county that is under the jurisdiction of the commissioners court.
3232 (b) The commissioners court of a county may by order apply
3333 the county's traffic regulations to a public road in the county that
3434 is owned, operated, and maintained by a conservation and
3535 reclamation district organized or operating under Section 52,
3636 Article III, or Section 59, Article XVI, Texas Constitution, and
3737 located wholly or partly in the county if the commissioners court
3838 and the board of the district have entered into an interlocal
3939 contract under Section 791.036, Government Code.
4040 (c) A public road that is subject to an order under
4141 Subsection (b) is considered to be a county road for purposes of
4242 applying a traffic regulation to the public road.
4343 SECTION 3. Section 251.155(a), Transportation Code, is
4444 amended to read as follows:
4545 (a) The commissioners court of a county may adopt
4646 regulations establishing a system of traffic control devices in
4747 restricted traffic zones on:
4848 (1) property described by Section 251.151(a); and
4949 (2) property abutting a public road that is the
5050 subject of an order under Section 251.151(b) if the property is
5151 owned by the district that is subject to the order or is a public
5252 right-of-way [251.151].
5353 SECTION 4. This Act takes effect immediately if it receives
5454 a vote of two-thirds of all the members elected to each house, as
5555 provided by Section 39, Article III, Texas Constitution. If this
5656 Act does not receive the vote necessary for immediate effect, this
5757 Act takes effect September 1, 2013.
