8	8	AN ACT
9	9	relating to regulation of traffic in a conservation and reclamation
10	10	district by a commissioners court.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Subchapter C, Chapter 791, Government Code, is
13	13	amended by adding Section 791.036 to read as follows:
14	14	Sec. 791.036. REGULATION OF TRAFFIC IN CERTAIN DISTRICTS.
15	15	(a) This section applies only to a county that has a population of
16	16	more than 80,000 and less than 130,000 and borders a county with a
17	17	population of more than 2 million and less than 4 million.
18	18	(b) The commissioners court of a county may enter into an
19	19	interlocal contract with the board of a conservation and
20	20	reclamation district organized or operating under Section 52,
21	21	Article III, or Section 59, Article XVI, Texas Constitution, to
22	22	apply the county's traffic regulations to a public road in the
23	23	county that is owned, operated, and maintained by the district if
24	24	the commissioners court finds that it is in the county's interest to
25	25	regulate traffic on the public road.
26	26	SECTION 2. Section 251.151, Transportation Code, is amended
27	27	to read as follows:
28	28	Sec. 251.151. AUTHORITY OF COMMISSIONERS COURT TO REGULATE
29	29	CERTAIN ROADS. (a) The commissioners court of a county may
30	30	regulate traffic on a county road or on real property owned by the
31	31	county that is under the jurisdiction of the commissioners court.
32	32	(b) The commissioners court of a county may by order apply
33	33	the county's traffic regulations to a public road in the county that
34	34	is owned, operated, and maintained by a conservation and
35	35	reclamation district organized or operating under Section 52,
36	36	Article III, or Section 59, Article XVI, Texas Constitution, and
37	37	located wholly or partly in the county if the commissioners court
38	38	and the board of the district have entered into an interlocal
39	39	contract under Section 791.036, Government Code.
40	40	(c) A public road that is subject to an order under
41	41	Subsection (b) is considered to be a county road for purposes of
42	42	applying a traffic regulation to the public road.
43	43	SECTION 3. Section 251.155(a), Transportation Code, is
44	44	amended to read as follows:
45	45	(a) The commissioners court of a county may adopt
46	46	regulations establishing a system of traffic control devices in
47	47	restricted traffic zones on:
48	48	(1) property described by Section 251.151(a); and
49	49	(2) property abutting a public road that is the
50	50	subject of an order under Section 251.151(b) if the property is
51	51	owned by the district that is subject to the order or is a public
52	52	right-of-way [251.151].
53	53	SECTION 4. This Act takes effect immediately if it receives
54	54	a vote of two-thirds of all the members elected to each house, as
55	55	provided by Section 39, Article III, Texas Constitution. If this
56	56	Act does not receive the vote necessary for immediate effect, this
57	57	Act takes effect September 1, 2013.
